1. I arrived at the courtroom at a little past 8am.
2. I headed for the sessions courtroom.
3. I waited there.
4. No press or photographers.
5. Checking the court notice board. Only BM's named appeared. It also indicated that he might not be present, only his lawyer would be.
6. After waiting around, I found a notice on the side door for staff - "Court X proceedings had been moved to another Court Y. The Judge Tuan Alaudeen who presided over the case the last time was said to be attending a seminar.
7. I looked at my watch and I hurried over to Court Y. It was still locked at quarter to 9 o'clock.
7. Waited until the staff came to open the doors.
8. DPP and lawyers came in. Their usual chit-chat before starting work.
9. I was suprised to see BM led into the courtroom still in handcuffs, his expression sullen and wearing a collared T-Shirt which was faded light grey and a black pants. Sharon was in her Kajang Prison t-shirt and blue jeans but she was not handcuffed.
10. I sat directly behind them. The took no notice of me. As there were 3 police personnel with them I didn't attempt to ask them anything.
11. Watching them, they looked like the were making the best of things. Since they were seperately remanded. All this while the judge haven't come yet.
12. At 9.30 the Juddge, Tuan Zaki. A stately looking man with a beard and a grandfatherly wiseman look took his place.
13. BM's case was the second one mentioned. The court staff informed the judge that there was a problem.
14. His lawyer was absent!
15. The judge ask the Marsden, "Where is your lawyer?", BM replied "He said he would be attending."
16. The judge then ask the DPP Syed (from last time) what was the reason for this hearing, he was told by the DPP Syed that the Marsden had asked for a reduction in bail. He then said he would postpone it to the 25th May, (Friday) if it was agreeable.
17. DPP Syed asks the Judge to give the Marsden Lawyer time to show up.
18. Another case was read.
19. BM's lawyer, J Kuldeep showed up about a half and hour later.
20. He looked rushed, his hair not slicked not unlike the other day when he was dashing and handsome.
(just and observation )
21. He apologise for his tardiness and told the court something unexpected had come up and that he had a urgent court case or something in KL.
22. When told about the postponement, he agreed on the date given.
23. The court staff then informed the Marsdens.
24. He left. The DPP left. The Marden were then escorted out.
25. I hurried out the door to try to catch a glimpse of them but the were led to a secure area for prisoners thru the back. I heard their lawyer ask for them and he was told to go there.
26. I left the court.
Trip Report.

Arrived at Nilai at nearly midnight, took a cab to my hotel. It was near New Mark Business Centre. I wanted to see the nightlife there. A karaoke and several eatries was open. But the entire place was dead quiet.
The hotel I stayed in was clean and comfortable. Much better than the one that had "el roaches." But I was miffed to find my complemetary coffee and tea misisng. I didn't complain as it was past midnight and I didnt want to drink any way.
I woke up at 6am, showered and got ready to for b/fast. I headed for the court at 7.30am
Activities:-
Took some additional shots of the Bistro.
Took some shots of the piles of letters at NewMarkBusiness center.
Do you want me back on the 25th May? I have to start making plans. Please advise.

In relation to the call for further financial donations to support a representative (the bat$) for the purpose of gathering information on behalf of interested PIPS memebrs at the Marsden trial I wish to make the following suggestions.
I would be happy to make a donation to help fund our presence but not using egold,perhaps a ROL Club sponsored bank account could be used to receive EFT donations,and name of donors and the amount could be posted on Rol Club.
A useful role for the bat$ while he is over there would be to approach Court Officers this week and ascertain if it is possible to get access to or copies of the Marsden Trial transcript when it takes place at this stage in September 2007.
If it is at a cost that is something PIPS investors will want to know and may want to fund with a view to having some documentary evidence of what did actually happen to our money.

Bobglyn & Gwendolyn, thank you for your gesture and hearts to help out. i think there will be a way, we will work something somehow.
Baabaa has a good direction on making matters more concreyte as to serve the wider interests gain from a resolute reach on the follow ups which will somehow deliver what most are wanting to know and be confident of an affirmative closure sometime in the near future.
As much as Marek and I would like a better way to assist with a smoother flow of the funding, and although I personally do not support the idea of EGold or any Ecurrency involved to help transact, it appears to be a simpler and more effecient way to apply it.
If I wasn't worried about how my country's stringent tax laws are, I would not mind letting my business acct at PayPal help out.
The fiscal consequences is what I am not willing to be subjected to and this i am sure, many will be looking at it this way as well... hence, the accessibility through EGold seems the best option and fortunately, Marek is willing to allow his current and valid Egold be put to use and serve even though many are not at all excited by this option.
We will work out something and let it be known, the cheaper way out where almost no one is imposedby bank feesand loss at charges on any personal involvement should be affected here unless necessaary... but as I see it, and looking at the struggle of funds to be collected from donations, both Marek and myself and certainly most of you, would dislike the idea of a portion, big or small, be struck off to accommodate banking fees and conversion costs.
Should we decide and approve a wire transfer of some kind, that Marek can receive through an account he can spare, we will let you know. Untill then, please hang on we will come back on thhis pretty soon.

Bolded in red is not likely to happen, for our Representative is not , in the eyes of the Malaysian Law, acting n any legal capacity whatsoever. This is an open, public and voluntary role however many people stand to back it, not unless we engage a legal Representative, which at the start of this option as a initiative we see feasible, had considered the financial side that will lead it to.
At the statistics so far gathered on the funds, remarkable as it may appear, it is far way and below of any substantial amount to even contemplate the services of a local solicitor to act on all our behalf...oops, I couldn't help using the "our" for my part.
I am just showing my solidarity here and I know, many more are participating to give a moral boost too however, I don't mind personally evewn after setting my feelings aside on this but there are just too many of you out there that are going through a hard time accepting this outcome!
So, we will try to help out as best as we can somehow.

Vested Interest
I have a vested interest in both not pouring good money down the drain but also in supporting the person whom I invested both my money and good faith in.
I think as a collective there is room to back BM with legal representation. Is there someone on the ground who can find an appropiately versed lawyer there?
It is in all of our best interests to get the best result from this trial regardless of its outcome...No regrets.
I appreciate those finding a way that we can contribute without incurring undue costs and look forward to knowing how to do so.

Mr. Marsden's court appointed lawyer is undoubtedly "appropriately versed" even if his timekeeping is a bit awry!
There is perhaps no better comment on the situation than to say that it is remarkable for a company with an asset base of $700 million, not to be able to afford an attorney.
