Like you, I have realised that there is not a single reliable HYIP out there. I too lost more money to learn that lesson!

If BM is guilty of perfidy (do you like that word?), then we are equally guilty of gullibility! But fortunately our sin does not land us in a third world jail!

I don't wish a year in a Malaysian jail on anyone, and especially not a European. I find your final sentiment harshly dissatisfying.

Was it nice for you? Easy to say if you had your "investment" returned (Supposition) partially or otherwise. As for me being as you say a "third world" citizen you would understand that the amount of money we entrusted to this "man" was a lot to us. My money, my mother's (widow) meagre saving and siblings. Thanks to him were are left in the lurch.

As the economies turn to recession, as in U.S., it puts more pressure on everyone, so the frustrations with being scammed and no hope of even the usual .10 on the dollar returned is not going to happen in this case for it was a pure scam, not a pure investment as we were all duped into believing.

I can relate to Bat$ comment, and I am sure many more will have to come to the reality that he is right, this was a scam from the start, and many of us were lied to face to face by Bryan, which in my opinion makes it worse, hence, some more hurt than others, so obviously, with dreams stolen, they are even more mad than the average small investor.

It is best to put this scam behind you and move on, there is no reason other than curiosity to hang onto any hope of a dime being returned as even this is futal. Reality is whatever small percentage of money was seized will be drained by this long and drawn out investigation and trial and period, so forget any chance of a refund.

As some commented, I wouldn't wish my worst enemy jail time in any third world country, but in this case, with so many dreams destroyed, I do hope they both enjoy a life long stay for we all know now what cunning liars they were, and I would hate to think of them ever having the opportunity to rip any other poor soles off as they have done with PIPS. Remember, he lied on and on, and one thing I have learned over the years, once a liar, always a liar, so they need to be kept in jail for life in my opinion, no matter how bad the conditions.

Far too many average small time investors got hurt to the point of losing everything with this scam, and it is one thing to be a Robin Hood and steal from the rich to give to the poor, but Bryan chose to steal from the poor and pr****d to give to the poor, and it does not get any lower than this in my opinion. Taking greedy wealthy investors in one thing, but taking the poor and needy is unthinkable, so I too hope they stay in jail for the sake of others they will scam if they get out. Another thing I learned long ago, once a scammer always a scammer.

Pain is what most have and are suffering as a result of whatever interpretations one gathers... being ripped off is not a pacifying thought for feeling pardonable on the culprits... we are after all, humans to muster that emotion on natural reflex.

It was also attributed to the fact that when the "offer" was spread around, it was based on two factors.

1- The deliberate and long term strategy that was right up the Marsdens sleeves and the tactic to be applied is to come out appearing clean & convincing that even the temporarily paid-out lieutenants or cheer leaders some regard them as, would be conned to follow the despicable untruth. The word is, go forth and redeem and when the moment is right, DISAPPEAR for good for all it takes and what's worth with millions gathered and/or stashed away and also, having converted into equities (with the legal protection of the property Laws governing in Malaysia), they could pull off this dream "heist" carefully thought out. Remember, it takes and needs some time to have this made successful...

2- Those, we i.e., in the meanwhile were "led to understand & believe" in this Marsden Malaysian-spread of rich money that will be and was also, invested BIG Time and ROI is flowing out and based on that simulation formula everyone has to follow through with timely approved payouts... subject to his "signature"... remember that debacle that even went onto the discussion floor in Hawaii???

Alright, he led us to believe, as we all were drawn to that exceptional concocted formula for a solution that sounded unprecedented by Brian Marsden by formulating & turning (his outside the box theory) the economic tables into a reality... and why shouldn't we believe that was a possibility???.... for laymen we all became at his feet to believe his vision of a financial future?

He knew the score, he knew the stakes, he was aware that he was handling our money for a different cause as opposed to what he openly declared and ridiculed our intelligence for trusting his predictions....

Well... say what you like but we were to a point, made fools out of our actions and gullibility or greed, is but a percentage involved.
Brian Marsden, with his deliberate act planned way in advance to deceive and by George... he almost pulled it off Scott free... which he didn't... fortunately, thanks to the loss of some and many more dissatisfied grievances, he and partner are now where they stand trial for what is regarded as Fraud and more is yet to be determined.

There is no trial today and it has been postponed as feared. New dates as follows.

4th, 6th and 7th August 2008.

As the trial of the slain Mongolian woman begins again today, the "movie star" lawyer must have asked again for a later date. There were talks about getting another lawyer and I was told by a source that there would be trial today but the same thing happenned again.

Sorry folks. So disappointed.

Learning also of Batty's weak health as a result of an ongoing sustained ailment, which also affected his physical mobility and he is still confident he shall overcome it despite currently house-restrained. I am sad and may our prayers to his health improve and pains reduced somehow.

The Bat$ predicted this trip would end in postponement, it did. Furthermore, a reliable and trusted source revealed to us that BM is trying to free his wife SM, but the authorities will not budge. As for the money we deposited it will belong to the government, we WON'T be getting it back, not our speculation but is as good as from the source's mouth related to the prosecution.

According to the source, Batty told us, it was revealed that the authorities do not believe the balance BM has in the bank which remains frozen is all the money he took. More is still unaccounted for. It is unconfirmed but the source thinks the local FBI will also look into the matter.

The authorities also knew about BM's convention in Hawaii, Langkawi and the Philippines.

6.00am - Got ready
7.00am - Got into a taxi heading for the KL Court
7.30am - Arrived in court, waited until 8.30am
8.30am - Get in line to make inquiries
9.00am - Searching for the courtroom in the massive complex.

9.15am - Found the Court and entered it.
Judge on leave!!! Cases reassigned to another court.
9.20am - At another court, lots of prosecutors, lawyers and
defendants. No press.
9.45am - Still no sign of the judge and BM or SM.

10am - The crowd of people thins.

(Overheard, conversation of court officers regarding BM who is still in custody in Seremban, not here today!)

10.30 - I get a chance to get a trial update from a court official,
new date set tentatively 11 to 15 August 2008.

Summary:
Judge on leave, the replacement judge was not in. No Mr. Moviestar lawyer today. As usual, I have disappointing news.

Yes, it would appear to be obvious to even the most loyal supporters of Marsden that this deal is long gone over and no one will see a dime, just a waste of time for Bat$ at this point. Sure was appreciated by everyone, but sooner or later everyone has to come to the reality, we were all ripped off and let it go, I know I have.

Thanks to Bat$ (and may his health improve!) and to everyone else for keeping us up to date. The only question remains is "Under what rule or law does Malaysia keep the money and return it to those of us that are rightful owners?"

We should at least returned a portion of the money we "invested" - particularly those of us that NEVER received a dime previously. Just getting 10 cents on the dollar would help some of else survive. The Government of Malaysia really should have NO claim on any of the money. Our intended investment was not illegal. It was only Marsden's lack of responsibility that was illegal. We should petition to have our funds, however meager, returned to their rightful owners.

I hate to be the bearer of bad news, but PIPSters are not primary creditors. In fact, PIPSters are at the bottom of the list. While BM changed the name from investment to a loan, in doing so he did not create the PIPSters in a superior position to other creditors. No matter what you want to call it, you "invested" money in PIPS. As such, your standing in the line of people to be paid out puts you at the bottom. I know this is not the information you wanted to hear. Owen can more clearly explain just how all of this works much better than I can.

The ony way PIPSters will receive any money is if there is any money left over after the true creditors have been paid, and the Malaysians. So I wouldn't get my hopes up of getting anything back if you are not Malaysian.
