The name of the people

Based on the approved by the House of Representatives and approved by the presidency and the basis of the provisions of item (I) of article (61) and item (3) of Article (73) of the Constitution.
Law issued the following statement :

Law
The first amendment to the law uniform retirement
رقم (27) لسنة 2006No. (27) of 2006
Article-1-cancels the text of the article (1) of the common retirement (No. 27) of 2006 and replaced by the following :
Article-1-First-provisions of this Act and the State Employees civilian, military and security forces and the staff of public companies located in the service force of the law on those who receive a salary from the state and are deducted from their salaries, pensions arrests functional assessments.

Second-imperative to refer to the employee retirement in one of the following circumstances :
أA - when completed (63) the third session of age is the legal age for retirement, regardless of the length of service unless the law provides otherwise.
B - If the medical official bodies being unfit for service.
Third-Chairman of the Council of Ministers proposal from the relevant minister or head of the Ministry of non-extension of service for a period of less than three (3) years upon completion of the legal age for assignment to retirement.
.IV-A staff member may request retirement if he had completed the age of fifty (50) years of age and older had a service pension of not less than (25) Twenty-five years and the relevant minister or head of the non-related to the Ministry or any of them is empowered to decide on his request through (45) forty-five days from the date of registration of demand in the employee and reversed longer allocated to the employee retirement eliminated.

اArticle-4-cancels the text of the article (6) of the Act and replaced by the following :
.Article-6-First-employee who deserves to be forwarded to the retirement pension if the pension actual length of service of not less than (15) fifteen years and under the age of 50 (fifty) years.
Second-service of the deceased and the assignee to retire for health reasons got him in the course of service and be unable totally unable to work (15) to fifteen years if they are less than for the purpose of calculating pension.
Rule-5-cancels the text of Article (7) of the Act and replaced by the following :
Article-7-count first-retirement salary of the employee on the basis of cumulative rate of (2.5%) two and a half% of the rate of salary in the last service pension for each year of service pensions in one of the following situations :
A - If the age of retirement is not less than sixty (60) years of service with pensions of not less than (25) twenty-five years.
B - If the age of retirement is not less than (55) : Fifty-five years with the service pension of not less than thirty (30) years.
C - if it was allocated to the retirement for health reasons.
دD- if he dies during service
E - if the military or security forces associate at the date of retirement of not less than 50 (fifty) years with the service pension of not less than twenty (20) years in the conduct.
Second-in cases that do not fall under the provisions of item (I) of this article pension is calculated on the basis of a cumulative amount (2%) 2% of the rate of salary in the last service pension for each year of service pensions.
Third-in the case of separation or removal from his post for reasons arising from his salary rate is calculated on the basis of the salary of career ranked first for the degree of functional minimum degree.
Fourth-rate salary intended career in the service scheme for the purposes of calculating the final salary pension as follows :
A-rate salary to the employee (12) during the twelve months that the Anevkakh history of the post before 2001.
B-added to the employee's pay rate set forth in paragraph (a) of Item (IV) of this article salary rate (12) twelve months for each year starting from the year (2010) will be equivalent rate of salary with the growing proportion to the rate of salary.

C-not reflected service and salaries of less than full salary for the purposes of calculating the rate of salary to the employee.
V.-only pays the pension of retired only if it had completed the 50th (50) years of age and in any case does not detract from the period prior to the completion date of this age with the exception of money into retirement for health reasons.
Sixth-longer length of service, which less than a year and over (6) months full year for the purposes of calculating pension and neglect if (6) months or below in all cases not calculated complement year for pension entitlement.
Seventh-shall not exceed the pension (80%) of the 80th% from the last salary and an employee in the career service pensions.
Eighth-must not be less pension for employees covered by the provisions of this law :
A - (150) one hundred and fifty thousand dinars if the length of service pension of not less than (25) twenty-five years.
B- (130) one hundred and thirty thousand dinars if the length of service pension of less than (25) twenty-five years.

Article-6-cancels text item (ii) of Article (10) of the Act and replaced by the following :
Second : the ministry or organization is not related to the Ministry to reconsider retired to retire if his reappointment under an order issued by the Council of Ministers or the Prime Minister shipped back to retirement the same way.
Article-7 - is the text of the article (13) of the Act and replaced by the following :
Article-13-First-similarity deceased (his successor) who deserve a pension are :

C-girl
D-mother
E- Father
Second-deserved retirement salary domestic successor when the conditions set forth in the Act as follows :
A son and daughter-minor under the age of eighteen years of age until the age of twenty him that it is continuing to study the prep or up to the age of six and twenty years of age that it is continuing to university study.
B-wife that did not have a fixed income and interrupt them when marriage is not at divorce or widowhood.

Third-payment of retirement son and successor of the girl after solutions to spare their pension as follows :

Article-8-cancels the text of the article (16) of the Act and replaced by the following :
Article 16-- - I. Upon the death of an employee or retiree salary pension distributed to beneficiaries from behind by (50%) of the 50th% found that one receivable, a rate (75%) and seventy five% of the two were equally distributed between them, and (by 100%) of the 100th% that were three or more evenly distributed among them.
Secondly re-distribution of pension to eligible successor, in accordance with the provisions in item (I) of this article when cutting domestic pension from any of them.

Article-9-cancels the text of the article (18) of the Act and replaced by the following :

Article-10-cancels the text of the article (19) of the Act and replaced by the following :
Article-19-First-borne state budget as follows :
أA-Pensions for retired prior to the entry into force of the law including rewards scheme.

Second-continue the count and pay retirement pensions or remuneration scheme set forth in item (I) of this Article, taking into account the provisions of Chapter V of the law in granting a pension domestic successor.
Article-11-First-cancels the text of paragraph (b) of Clause (I) of article (20) of the Act and replaced by the following :

Article-13-cancels the text of the article (28) of the Act and replaced by the following :

Article-14-Delete the article (29) of the Act.
Article-15-cancels the text of the article (30) of the Act and replaced by the following :
Article 30-for-proposal of the Council of Ministers and Minister of Finance amending the pension upon the availability of funding, according to the following :
First Amendment : the salaries of retired before the entry into force of the law after the approval of the Council of Ministers of the way the proposed amendment.

Article-16-cancels the text of the article (31) of the Act and replaced by the following :
Article-31-First-repeal legal texts to be retired or accrued to a pension, contrary to the provisions of this Act, except for the deficit staff health (No. 11) of 1999 and CPA order No. (63) of the 2004 Special privileges granted to the public security sector because of disability, death and Cabinet Order No. (10) of 2004 Special compensation for the dead and injured as a result of terrorist acts, the matter (17) of 2004 (pension rights granted to a martyr and the deceased ministers and low-grade special and general managers), and Order No. (18) of 2004 (granting pension rights), and Order No. (6) of 2005 (Amendment Act University Service (No. 142) of 1976), Order No. (9) of 2005 rate Order No. (31) of 2005 (pay pensions), and legislation on retirement of judges (the resolutions of the Revolution Command Council (degenerate) (No. 1021) in the September 13, 1983, (No. 120) on August 20, 1997, (No. 145) on June 18, 2001, Order No. (52) of the Coalition Provisional Authority for 2004) and item (ii) of Article (6) of the Order (30) of the 2005 the law of the Federal Supreme Court and Law No. (3) of the 2005 Law of the National Assembly and the pension rights of members of the Interim National Council No. (14) of 2005.

Article-17-This Act shall be published in the Official Gazette and is effective from the date of January 17, 2006.
Reasons
