Maybe Marek can tell us if he's been in contact with BM! A simple yes or no would be good...If it's yes, maybe could say that "things" are progressing...

I'm usually not into a lot of speculation but I am very curious what that means?
Does it mean the investigation is over and he's fevourishly working to get things back online? That would make sense because as soon as he says it is back up and running, there will be a mad rush!!!
Does it mean he's starting over with the Lotto and wants to stay buried in the programming until it is up? I'm just not for sure....

I would like to hear from him so that I know that he's not incarcerated.
I'm hoping the same! BM is busy and hopefully he's busy with the restructure program. We all know he's busy with the lotto...Maybe his post a few weeks ago of "good news" will be GREAT NEWS soon?!

I have been reading your posts for weeks now -- the good and the bad. And regardless of what has been posted I have remained positive. The thing that is starting to deeply trouble me, however, is the fact that we were all told last month (and it was confirmed by a number of people) that the Bank of Negara had finished its investigation. In fact, several posters stated that they had even called the bank themselves and that the bank had confirmed that fact. With that in mind, why then, is the bank still holding up Bryan's funds and servers? I don't get it.
Indeed, if Bryan is innocent of any wrongdoing, which I and the rest of you, I'm sure, believe he is, then how is it that the bank can continue tying up his (and therefore our) funds and business interests like this? On the other hand, if the bank has determined that Bryan has done something wrong, then why haven't charges been filed against him? I'm sure everyone in the US, at least, understands the concept of either having to file a charge against someone, or letting them go. You cannot detain someone indefinitely you haven't charged (with a crime) as it violates due process and invites suit.
I am a paralegal and have been for seventeen years, and while most of my experience is related to civil law, I was trained by a former State's Attorney who went into private practice and did manage to work on a few criminal cases with him during that time. And all I can tell you is that something simply is not right here. If the investigation is over, charges should have either been filed by now or Bryan's funds and servers released. Period.
I think the Almighty, All-Knowing Bank of Negara that is holding all of our lives in its hands needs to know that we exist, and that it -- not Bryan Marsden --is hurting us and that we intend to do something about it.
In sum, does anyone know a Malaysian law firm we could be put in touch with to retain, then have start making noise on our behalf over at the BN? After all, as I learned in one of the first legal classes I ever attended -- whether it be civil law or criminal law -- when you want to try to figure out what has happened in a given case, first ask yourself who stood to gain the most by what happened. Well, ladies and gentlemen, in my book, that would be the Bank of Negara...which, for the last six months, has had millions (perhaps billions) of Bryan's/OUR $$$ frozen in its vaults.
Hang on PJ, either I or somebody else here will get for you some Malaysian procedural excerpt from a statute or manual which states that a referral after an investigation is routinely made to the prosecutor to either move forward or end the whole thing there. I am not the last word on this however, but from what we've been shown it appears this is part of the due process sheme over there at least.
You cannot email Bryan as this function has been disabled and you cannot even send a private message as the "user" wishes to receive no mail!!
Hopefully Bryan is busy with setting up the restructuring of PIPS - this silence is the only explanation as if you all remember - "we are almost ready to roll" (lotto) has been a couple of weeks now. They were twicking the programme? Could that take so long??

Thank you, whatever, for your response and for trying to shed some light on this matter. I'll await your posting of the relevant statute. It will be especially interesting to see what Malaysian law has to say about the element of time relative to investigations and the filing of charges, because as we all know, time is money (made or lost). That's really what it all comes down to...literally every instant that these funds remain in a "frozen" state by the Bank of Negara, Bryan/we are losing money.

I know "patience" can get on ones nerves but, certainly in these times where things seem to be moving more than before... imho it is very important. In case the current silence is a bad sign, there is no much we can do anyway. If it is a promising sign, imho we can only win by giving it all time it needs.
Further - and this might be what whatever refers to? - it may ease your mind to know that a European country's embassy is following up the case on behalf of one of the pipsters around here... and I guess (t)he(y) keep us informed while they can. Putting more folks on the matter will have no added value, on the contrary. I think this embassy is one of the best kinds of representation we can have there...
Don't expect this case to 'fly forward' just because of this. In our western world justice doesn't let itself to be pushed too much and I guess it is the same over there. But... imho one can keep faith that the the right people are following up the case.

Not to long ago one of the members posted an excerpt either from Malaysian law or a government manual that spoke about the procedural process regarding investigations and it said that after the investigation is completed it is automatically referred to the prosecutors office for a decision. I don't have alot of time today but was looking for it for our paralegal member PJ (see previous post before mine). Thanks!
What is strange is we're not even hearing any 'rumours' as to what's going on. You'd think someone would know.....
Waiting patiently this long is even by Oriental standards... outstanding & it is indeed a long patient haul that has won over all odds.... hence, waiting another year perhaps should sustain many cheerful hearts while awaiting for the good outcome...soon to surface:biggrin: :waiting:

We have been in contact with Banc Negarawho said that the investegation NOW is finished.
They (BON) are now turning over the case To day or to morrow to the State attorneys office for further investegation.
They expect the investegation there will take another 2 months.
If you want us to follow up with additional questions to the State attorney`s office so just tell us to do.

IF this is true... it's no more or less a confirmation of what imho anyone with common sense could expect: justice takes it's time. So we (and I plead guilty too) should (check in if there's anything new now and then but) better don't hang around too long waiting for pips... but go out and live our lives to the full... and, maybe, you never know, one day be taken by surprise... :wink:
