Let's only adhere to the facts in accordance to what we know!
Charges Being:
Malaysia Anti-money Laundering Act - Bryan & Sharon Charges
Section 4(1) Section 87(1)
4. Offence of money laundering
(1) Any person who— (a) engages in, or attempts to engage in; or (b) abets the commission of, money laundering, commits an offence and shall on conviction be liable to a fine not exceeding five million ringgit or to imprisonment for a term not exceeding five years or to both.
87. Offence committed by any person acting in an official capacity
(1) Where an offence is committed by a body corporate or an association of persons, a person— (a) who is its director, controller, officer, or partner; or (b) who is concerned in the management of its affairs, at the time of the commission of the offence, is deemed to have committed that offence unless that person proves that the offence was committed without his consent or connivance and that he exercised such diligence to prevent the commission of the offence as he ought to have exercised, having regard to the nature of his function in that capacity and to the circumstances.
Before me move forward, let us please except that
these are the facts according to the charges.
Hardly deniable, right? Only the facts.
If you disagree with the charges, then please argue with BNM,
since they set the rules in accordance with Malaysian law.
(And yes they are the governing entity for Malaysia in such affairs)
And just in case you think that the charge is trivial please remember
that:
"DPP Dzulkifli Ahmad proposed bail at RM1mil in two sureties for each, saying that money laundering was a very serious offence."
You might want to consider the bold part of the charges, since this
does appear to be the most critical point to be proved otherwise,
at least according to Law!

Very serious charges indeed whadyano.It would appear that the onus is On Mr and Mrs Marsden to prove the blame lies with others.If substantial fines or Jail is to be avoided that is.Be interesting to see what steps BM actually took to prevent the collapse of pips.

Also don't forget they have also been charged with Illegal Deposit Taking, and Receiving Funds From Unlawful Activities (read PicPay). Maybe Bat$ could shed some light on what kind of sentence these 2 charges carry. Any idea Bat$?

Interesting to know how one can avoid the collapse of a Ponzi! Maybe that's the formula he had locked away in the safe.

I will be closing this thread and a string of others as well that are rather repetitive and only leads to confusion and disarray for returning members wanting to trace or track related posts concerning the current development some call it a stupid saga, a farce and even a silly & endless waste of time, well whatever anyone feels opinionated by their individual viewpoints or argument, the Trial on the Marsdens is NOT over and far from closure hence, a main sticky thread will cater to that attention
