GreenZap Files $57.5 Million Lawsuit Against Bloggers and Website Hosting Company

GreenZap Files $57.5 Million Lawsuit Against Bloggers and Website Hosting Company

SAN DIEGO--(BUSINESS WIRE)--GreenZap®, Inc. (Pink Sheets: GZPN - News; the "Company"), an online payment provider, has filed a lawsuit against website-hosting-company Liquid Web, Inc. and Vodien, Inc. for a total of $57.5 million. The suit is the first of many GreenZap is preparing against individual bloggers and hosting companies that maintain websites where defamatory comments are being posted concerning GreenZap and its executives.

According to GreenZap Vice President Linda Murphy, attempts made by GreenZap to communicate with the bloggers were met with malicious attacks. GreenZap's counsel sent several letters to Liquid Web, Inc. requesting it voluntarily shut down one of its hosted websites due to its harmful and libelous content, but to no avail. The registered owners of the website, Vodien, Inc., have a Singapore address and have ignored GreenZap in spite of the company's attempts. In addition to the hosting company, GreenZap has been able to identify several individual bloggers responsible for many of the postings and intends to add them to the action.

According to GreenZap CEO Damon Westmoreland, "The websites are nothing more than an online soap opera. There is advertising on these sites and the owners are getting paid based on the traffic they receive. Our company grew quickly over the last year, acquiring over 750,000 users mostly in the direct sales market, which presented an opportunity for these cyber-offenders to ride our coat tails and make a buck by defaming our company."

Ms. Murphy said the blogs have been damaging to the Company's growth creating an ongoing cloud of mistrust that it is forced to address on a daily basis with its customers and strategic partners alike.

While the laws surrounding Internet user responsibility is still unclear, GreenZap is not the first party to commence an action against a hosting site. In October 2006, a Florida jury awarded one Sue Scheff $11.3 million in an Internet defamation lawsuit. The article revealed that Scheff filed a lawsuit after a blogger called her a "crook," "con artist" and a "fraud" on an Internet message board.

"With this type of precedent, recognizing the harm done to Internet businesses by these false blogs, we believe we can prevail and put a stop to the baseless st

atements and claims surrounding our organization," said Mr. Westmoreland.

I think it is a good omen and indication that steps are taken to prosecute those that went unabated to slander what was unfounded nor groundless with baseless overdrive hype and allegations through those Bloggs.

For many of you, who still holds a GreenZap account....esp. a Goldzapper... and living outside the USA, it is better and wiser to follow up with the required verification that is inevitable...in compliance to the recognition GZ has to meet with US legislations.

This re-verification would mainly apply to your personal details, yr recent utility bill, yr bank's recent copy displaying your acct #, address and name, plus another from either a passport or Driving licence. Should yr CC validity be expired, update that too.

This is esp. essential when you see the true benefits served which will soon be available, with the Debit Card and the wide ranging accessibility GreenZap will soon add and offer to many more members!

There are turbulent times evolving GreenZap. It appears that GZ has not heard the last of Texas to start off into another path of cotroversy that may end quite discouragingly for the operations within the USA hosted by Damon Westmoreland and GreenZap.

I have been updated by a keen member continueing carefull observations on the trails of GZ's venture since the early days and the latest information quoted to me is as follows:

    February 21, 2007

On January 30, 2007, Texas Banking Commissioner Randall S. James issued a Cease and Desist Order against GreenZap, Inc., La Jolla, California. The Order directs GreenZap to cease and desist from conducting the business of currency transmission in Texas. The company is based in California and offers currency transmission services via the Internet to Texas residents, but has no physical locations in Texas. GreenZap is not licensed in Texas to engage in this type of business activity as required by Chapter 151 of the Texas Finance Code. The Order became final on February 20, 2007.
Since they have not been able to obtain a license to operate as a money transfer agent or money processor I suspect more of these will be forthcoming.

I am perplexed myself and these recent developments and one can expect more turbulence to hop onto the media, we will just have to wait and watch inthe meantime.

After a long time with nothing from Greenzap, I received an update email from them on the 11th. In it, they offer a link to their 1Q 2007 report in *.pdf format. There is no mention of the Texas situation, but they seem to be getting back on target. Here is the link to the report: http://www.greenzap.com/newz/Company_Report_Q1_2007.pdf

I believe, it is heading in a 1-way direction...Down the gutters!! It won't make any recovery...not after trying to zap (steal) money from members bank accounts!!! It will be facing more courts and cases from States on the hunt (with writs) after the operators of GZ.
