    Iraq maps strategy to revive oil fields

    BAGHDAD — After months of contentious negotiations over the postwar spoils of Iraq's most valuable natural resource, the government announced Monday night that it had approved a draft plan to ramp up oil production and share the proceeds.

    The agreement by the Iraqi Cabinet was touted as a major breakthrough. It must still be approved by parliament, but because all of Iraq's vested ethnic and regional interests are represented in the Cabinet, the deal was viewed as having overcome a significant hurdle.

    The United States has long wanted to capitalize on Iraq's oil, especially as a means of paying for the country's reconstruction. Oil's importance was reiterated in the Iraq Study Group report released in December.

    The agreement would open the door to international investment in Iraq's oil industry — a bonanza for foreign companies — and produce revenue for a nation badly in need of money to rebuild.

    Iraq's oil riches lie predominantly in the Kurdish-controlled north and the Shiite-controlled south. Reaching an agreement essentially required both factions to be willing to share their bounty with Sunnis in the middle — a particularly painful prospect as Sunnis under Saddam Hussein controlled the entire government.

    But there were also more complex questions of provincial sovereignty versus centralized national power.

    Kurds, who are pushing a referendum on withdrawal from Iraq, wanted more control over their ability to strike contracts with foreign firms and spend the profits as they see fit.

    According to U.S. Ambassador Zalmay Khalilzad's office, all revenue from oil sales would go into a single national account, but all regions and provinces would have a seat on an energy policymaking body, and provinces would receive shares of revenue and have control over how they spent it.

    "This is a significant political achievement because leaders representing all of Iraq's communities have demonstrated that they can pull together to resolve difficult issues of vital national importance," Khalilzad said in a statement.

    In Washington, White House spokesman Tony Snow called a new oil law the "key linchpin" in Iraq's recovery.

    During a visit to Baghdad this month, Secretary of State Condoleezza Rice urged Iraqi leaders to pass the law, saying "it's really critical" to show signs of national reconciliation.

    The oil sector in Iraq has not been in full-scale development since the 1980s, and production has fallen far short of its potential because of government neglect of the industry's infrastructure and attacks on installations. Fewer than a quarter of its fields have been developed; production volume fell by 8% in 2005.

    Even so, it is the overwhelming source of revenue in Iraq and is expected to bring in $31 billion this year, based on projected exports of 1.7 million barrels a day at a price of $50 a barrel.

    It was unclear what concessions finally led to the compromise, and the precise terms of the deal were not immediately available. The U.S. has been pressuring the Iraqi leadership for months to break the impasse, and one Sunni politician said Monday night that the deal had been brokered by Khalilzad himself.

    Iraqi parliament members were cautious about the plan Monday night, noting that no details had been released. Still, most agreed that a Cabinet compromise was a good sign.

    "Definitely, if there is a Cabinet accordance, this would be a good key for a future accordance in the parliament," said Qusai Abdul-Wahab, a Shiite lawmaker.

    Others predicted a tougher battle for the proposal on its way to becoming law.

    "I think there will be great opposition to it in the parliament," said Rashid al-Azzawi of the Sunni parliamentary bloc known as the Iraqi Accordance Front.

    Some analysts say the law also will be viewed dimly as another way for the U.S. to get its hands on the country's oil.

    Antonia Juhasz, an analyst at the Institute for Policy Studies in Washington who has written extensively on the economic aspects of the invasion of Iraq, said throwing open the oil industry to foreign investment — which no doubt would include U.S. interests — would only heighten Iraqis' distrust of the United States.

    "It's a critical law that is being rushed through Iraq's government at a time when the government is highly susceptible to external pressure," she said.

    "Most people in Iraq assume the U.S. invasion was about oil. When the people of Iraq learn that the majority of their oil fields are being turned over to foreign private production … it worries me. I wouldn't want to be a soldier on the ground when the law passes."

    By Mohammad Al-Ghazzi BAGHDAD, Feb 27 (KUNA) -- The Iraqi Ministry of Oil has welcomed the new oil legislation in the country referring to it as "a significant long-awaited step." "The new legislation regulates management of (the Iraqi) oil sector and secures just distribution of crude revenues to all Iraqis," the ministry spokesman, Asem Jehad, told Kuwait News Agency (KUNA) on Tuesday noting that the law set the sound bases for developing the oil industry in cooperation with the world's leading firms.

    According to the ministry's media officer, the new legislation would help its restructuring and resumption of work at the National Oil Company which will be in charge of operating all the oil fields throughout the country as well as "the Iraqi oil exports." Iraqi Primer Minister Nouri Al-Maliki announced on Monday that the government had passed the draft oil and gas legislation and would send it soon to the Parliament to vote on it.

    The committee entrusted with the formulation of the oil legislation submitted the draft bill in December and submitted it to the government.

    Another day at the money bazaar. Just a mere 104 billion dinars pulled from circulation today. When I started tracking this process from the Central Bank, I would never have guessed that we would now be in the 150th day of the "Overt" reval plan. Quietly they might have been doing this for some time before they tipped their hand in early October. The mainstream US news agencies were carring the story yesterday about the "Oil Law", hopefully the Iraqis won't delay it much longer as Parliment decides the fate of the draft law. It concerned me yesterday that they were talking about having things wrapped up by the end of "May". In the big picture, that really isn't too far away, but from my perspective that I thought this would be done by the end of '06, it seems like a long time to me. I keep reminding myself to say "when", not "if". With that in mind, it's much easier to tackle my day to day responsibilities. Lets pray for sooner, not later. With that, here are today's numbers.

    Iraqi leaders yesterday approved a draft law opening the country's oil reserves to foreign investors.

    The bill, a benchmark laid down by President George W Bush for America's continuing commitment to Iraq, came amid immense pressure from British and American diplomats to enable foreign involvement in what was a nationalised industry under Saddam Hussein.

    The oil minister, Hussein Shahristani, promised that oil and gas resources would be "the property of the Iraqi people" and that revenues would be distributed equally among the regions.

    advertisement"The exploitation of Iraq's fields will be decided by a process of open bidding, based on model contracts," Mr Shahristani said. "The process will be transparent and open."

    Mr Shahristani said the cabinet agreed the draft law unanimously and expected it to "sail through" parliament.

    Sunni Muslims, who live in mainly oil-poor areas, had argued that oil and gas profits would be controlled by the ruling Shia majority.

    Kurdish leaders, who control half the reserves, stalled the bill last year in an attempt to preserve contracts signed independently with Turkish and Norwegian firms.

    Deputy prime minister Barham Salih said the regional goverment's deals would be modified to comply with the new legislation.

    Iraq's oil reserves are among the world's largest but production has fallen for decades and is set to tailspin this year. Washington forecasts a drop in output to 1.3 million barrels a day by the end of the year from just under two million in January.

    Under the new plans, foreign companies will be encouraged to establish joint ventures with a reconstituted national company.

    The son of Iraq's president, Jalal Talabani, joined aides yesterday in denying that his father was gravely ill in Jordan after a heart attack. They said Mr Talabani, 74, was suffering from fatigue.
    The vice-president, Adel Abdul Madhi, was slightly hurt in a failed assassination attempt on his convoy in Baghdad.

    ELEANOR HALL: Overseas now, and as the US continues its security surge in Baghdad, the Iraqi Government has taken a major step toward resolving one of the key points of political division between the country's three rival groups.

    After months of debate, a draft bill has now been approved by the Cabinet on how to divide up Iraq's oil reserves.

    The Prime Minister Nouri al-Maliki says the agreement is a gift to the Iraqi people.

    But analysts say while it's a positive sign, the deal is far from done.

    This report from Barbara Miller.

    BARBARA MILLER: Iraq is thought to have the world's third largest oil reserves. But until now the country's Shias, Sunnis and Kurds have been unable to agree on how to divide up the revenues.

    Now, the Cabinet has presented a draft bill, under which the money would split among Iraq's 18 provinces according to population levels.

    Some details have still to be finalised before the bill is put to the vote in Parliament but the Iraqi Prime Minister Nouri al-Maliki says it's an important step forward and places national interests above sectarian divisions.

    NOURI AL-MALIKI (translated): The Government realises the importance of the oil and gas law, which will ensure that all segments of the Iraqi people will benefit from this wealth. This will boost the unity of the Iraqis and their social cohesion.

    BARBARA MILLER: Those sentiments have been echoed by the US State Department spokesman Sean McCormack.

    SEAN MCCORMACK: This is an important step in that the agreement represents an agreement among all the major political factions in the Iraqi Government.

    It is also important in that it represents an indication that this Government is in fact working on an Iraq that would benefit all Iraqis.

    BARBARA MILLER: Most of the oil is located in the Kurdish north and Shi'ite south, so the deal represents a big concession to the Sunni areas in the centre of the country.

    Professor Amin Saikal is the Director of the Centre for Arab and Islamic Studies at the Australian National University. He says the other ethnic groups saw it as the only way of getting the Sunnis on board.

    AMIN SAIKAL: If they don't do it, then the present conflict and bloodshed will continue indefinitely and I think this is their way of basically trying to reassure the Sunni minority that under a post-Saddam Hussein arrangement, they will not be deprived of having a share in the natural resources of Iraq, which they had enjoyed more exclusively under Saddam Hussein.

    BARBARA MILLER: But that doesn't mean the Sunnis involved in the insurgency will be won over.

    AMIN SAIKAL: The main problem that they have is not so much with ordinary Sunnis, but more with the resistance. And whether the elements of the resistance will defect to the side of the Government as a result of this new law which has been passed, that remains to be seen.

    BARBARA MILLER: Feisal Istrabadi is Iraq's Ambassador to the United Nations. He thinks the draft deal will encourage the much-needed foreign investment.

    FEISAL ISTRABADI: I think that a reason that there has been some hesitancy on the part of the major players in terms of the international oil companies has been the fact that Iraq has not yet passed a hydrocarbon law, an oil and gas law.

    So, I think that as this law is seen to unite Iraqis, and as it is, I think it will be welcomed by the major players and I think that we will start to see the development of investment in the infrastructure in Iraq from the private sector.

    BARBARA MILLER: Fadel Gheit, a senior energy analyst for Oppenheimer and Company in New York, is not convinced.

    He says while oil companies will be enticed by news of the draft deal, they won't be packing their bags just yet.

    FADEL GHEIT: First of all they have to find a stable government to negotiate with, to sign a contract with.

    Two, they have to worry about personal safety here. The profit motive obviously is very big but I don't think that any company that I know of will be rushing to send engineers, geologists and technicians in Iraq, facing all the current anarchy, the sectarian violence and the lawlessness that is taking place.

    BARBARA MILLER: That's a view shared by Amin Saikal.

    AMIN SAIKAL: I think it is more a question of wait and see. You know, it's not so much a question of passing a law, it's more important whether you are really in a position to implement that law. So what Iraq is really lacking is security and that is what is really deterring outsiders to invest in Iraq at the moment.

    Iraq's cabinet approved draft legislation Monday that would enable the government to manage the country's vast oil resources and distribute revenue throughout the country, a step toward meeting a U.S. demand that the country's parliament pass such a law.
    In a reminder of Iraq's continuing instability, Adel Abdul Mahdi, one of the country's two vice presidents, narrowly avoided assassination Monday morning when a bomb exploded inside a crowded third-floor conference room at a government ministry in Baghdad's Mansour district.

    Abdul Mahdi, one of Iraq's most influential Shiite politicians, was walking toward the podium at an awards ceremony at the Public Works Ministry when explosives detonated beneath the seats, striking him with shrapnel but causing only minor wounds, according to Zuhair Hamadi, an adviser to the vice president.

    The harrowing security breach, in which at least five people were killed and more than 15 wounded, police said, illustrated the perils of political life in Iraq even as U.S. and Iraqi forces attempt to pacify the capital. Abdul Mahdi's brother was killed in 2005, and last year a bomb exploded outside his house in Baghdad.

    "I'm sure people knew he was coming to the ceremony maybe three or four days ahead of time, and they planned it," said Hamadi.

    The draft oil law, approved by Iraq's cabinet after months of intense negotiations, must still be approved by parliament. Ministers agreed to a goal of enacting the legislation by May, a senior Iraqi official said on condition of anonymity.

    "If this law is enacted, it is truly an important breakthrough to establishing the political economy of what we want to see: an Iraq that is democratic, federal and united," Barham Salih, one of Iraq's two deputy prime ministers, said in an interview. "These vital resources, and these revenues, are understandably among the most difficult and most contentious issues faced by Iraqis."

    The draft law calls for oil revenue throughout the country to be deposited in a federal government account and redistributed to Iraq's 18 provinces, most likely on a per capita basis, said Salih, the chairman of the negotiating committee working on the legislation. A secondary piece of legislation will address in more detail the mechanisms of revenue distribution, he added.

    The law would establish a Federal Council on Oil and Gas to oversee energy policy and determine procedures for negotiating contracts with oil companies and managing oil exploration and production. The law also would revamp the Iraqi National Oil Co. and give regulatory oversight to the Oil Ministry.

    "All Iraqis, irrespective of their geographic location, will benefit from these revenues. There will be no segregation or sectarian division," said Thamir Ghadban, a former oil minister serving as a consultant to the negotiating committee.

    The negotiators wrangled in part over how much autonomy regional authorities, especially the Kurdish territories of northern Iraq, would have to sign contracts with energy companies and manage oil fields in their areas. While the draft law would consolidate much decision-making authority in Baghdad, regional officials hailed the agreement and said they would still have certain independent powers over their resources.

    "The Kurdistan region will voluntarily share some of its constitutional powers to manage petroleum exploration and development in Kurdistan with the federal government," said Ashti Hawrami, the Kurdish region's minister of natural resources, in a statement on the regional government's Web site.

    In particular, the Kurdish regional government will allow a panel of experts to review the region's oil contracts and pool its revenue with the central government. "In return, Kurdistan will be guaranteed a share of pooled revenues proportionate to its population," the statement said. "The Kurdistan Regional Government will, of course, retain the power to sign contracts for petroleum exploration and development in the Kurdistan Region."

    The U.S. ambassador to Iraq, Zalmay Khalilzad, issued a statement praising the cabinet for reaching an agreement. U.S. officials have pressured the Iraqi government to approve the law in the hope that an equitable mechanism for managing oil resources would remove a source of conflict. Most of Iraq's oil fields are in the predominantly Shiite south and the mainly Kurdish north, prompting fears among Sunni Arabs that they will be left out of revenue-sharing arrangements devised by a Shiite-led government.

    Given that the cabinet represents all major parliamentary blocs, "prospects for the draft legislation becoming the law of the land are excellent," said Khalilzad. "There is still much work that needs to be done in the hydrocarbon sector. But a vital step was taken today."

    Also on Monday, U.S. officials announced the seizure of what they described as a large cache of Iranian-made parts for powerful armor-piercing roadside bombs, known as explosively formed projectiles, that officials say have killed more than 170 members of U.S.-led coalition forces over the past two years. U.S. soldiers, following a tip from an Iraqi, found the weapons parts, along with rockets and mortars, on Saturday, hidden in two large freezers concealed by palm fronds.

    "This was a great find for us," said Capt. Clayton Combs, the commander of the company that made the discovery in a village near Baqubah, about 35 miles northeast of Baghdad. "This is a significant amount. It probably saved a lot of lives."

    The roadside bombs are fashioned with plastic cylinders packed with explosives, and an attached copper plate turns into a smoldering projectile that penetrates armored vehicles. The cache included 150 of the plates in various sizes.

    Earlier this month, U.S. military officials briefing reporters in Baghdad on condition of anonymity said without offering evidence that high-ranking Iranian government officials were involved in supplying the deadly explosives to Iraqi militants. But at a briefing Monday, officials said they had no evidence of who supplied the weapons. A military explosives expert, Maj. Marty Weber, said Iran is the only known country where these types of components are manufactured.

    Military officials involved in the recent discovery said they were not sure to whom the weapon parts belonged or how they got to the village of al-Jedidah, where the Mahdi Army, a Shiite militia, has a strong presence. They said the fact that they found parts, rather than complete devices, suggests that some are being assembled in Iraq.

    The U.S. military said a Marine was killed Monday in Anbar province in western Iraq.

    Meanwhile, aides to Iraqi President Jalal Talabani, who was hospitalized Sunday in Jordan, said he is in stable condition. His office said Monday that the president was "fully conscious and in high spirits." He will remain in Amman to undergo more tests. Talabani reportedly lost consciousness Sunday after what his staff described as a series of stressful days.
