This came to us last night directly from the London former PIPS member/merchant who first wrote the letter to BoN. We were told it is a translation of brief from investigator. Will edit this if get more info.

Anyone know who the CofC is?

The central bank there is investigating it as an insolvent ponzi, straight up audit. There are no records indicating any underlying trading activity and apparently it was simply new money out to older liabilities. The impounded funds are in Malaysia, Singapore, Panama and US (Citibank clearing) and total somewhere in the area of $12M USD. There is also an issue of an insolvent payment processor (PICPAY) that had no independent assets and liabilities upwards of $640M USD. Mr. Marsden is on a bailment and has had his passport remanded, he is to have no contact with his client list and is not allowed internet communications. He is receiving an allowance from the impounded funds for living expenses and I suspect for legal expenses but that isn't clear in the translation.


The case is going to be referred for prosecution any day now, we think he's looking at at least 100 counts of wire fraud along with the LOFSA violations and the issues with the payment processor, possibly could lead to 345 years imprisonment, but they're likely to bargain that down to much less. There is very little likelihood of any funds being left for distribution outside of Malaysia, he has about $9M USD in liabilities there, plus any fines that would be levied. It's not worth much effort for any restitution, if that's where you're looking.


The CofC has acquired a list of the US account holders and the DOJ may attempt some restitution there for US citizens, they'd likely start out with criminal proceeding for Tax Evasion and/or laundering and settle them with consent decrees, outside of the open promoters I don't see any felony cases going to trial unless the people fight the civil restitutions.
