PIPS Case: January 4th 2007 for next mention

(3)Mahkamah menetapkan 4 Januari depan untuk sebutan semula kes ke atas pasangan terbabit yang masing-masing diwakili peguam, J Kuldeep Kumar dan S Puspanathan.

Pada 30 Ogos lalu, warga Britain itu didakwa di Mahkamah Sesyen Kuala Lumpur atas tuduhan melakukan tujuh kesalahan di antara 23 Disember 2003 dan 7 Disember 2004.

Dia yang memegang jawatan Pengarah Syarikat New Mark Business Centre Sdn Bhd dituduh menerima wang RM7 juta hasil kegiatan haram menerusi akaun PIC Capital Ventures (M) Sdn Bhd di Malayan Banking Berhad cawangan Jalan 3/76D, Desa Pandan.

Pada hari sama, dia bersama isterinya, Phan Sew Ken, 50, didakwa di Mahkamah Sesyen Seremban atas 41 pertuduhan berasingan menerima wang deposit hasil aktiviti haram berjumlah RM26.7 juta.

Pasangan dari Bandar Sunway, Petaling Jaya itu yang memegang jawatan pengarah di syarikat Pic Pay Dot Com Sdn Bhd didakwa melakukan kesalahan itu antara 4 Januari hingga 14 Jun 2005 di Eon Bank Group, Taman Semarak, Nilai.

Pada prosiding 19 September lalu di sini, mereka didakwa atas tujuh lagi tuduhan tambahan berkaitan kesalahan sama membabitkan wang deposit RM11.78 juta hasil aktiviti haram.

Marsden turut menghadapi dua tuduhan lain mengikut akta sama menerima wang haram RM106,000 menggunakan akaun persendirian bernombor 09610001964 pada 28 Januari 2004 dan 20 Februari 2004 di bank sama.

Pasangan itu didakwa mengikut Seksyen 4 (1) Akta Pencegahan Pengubahan Wang Haram (AMLA) 2001 dibaca bersama Seksyen 87(1) akta sama, membawa hukuman penjara sehingga lima tahun, denda sehingga RM5 juta atau kedua-duanya jika sabit kesalahan.

Kes berkenaan adalah yang pertama disiasat dan didakwa Bank Negara sejak AMLA diperkenalkan pada 2001.

Finally, a report in the malay national paper. Here's the translation.

(1) The Seremban Sessions court allows the transfer of 7 seperate money laundering charges on BM from the KL Sessions court to its court.

The decision to transfer the charges was made by Judge Alaudeen Ismail after no objections were made DPP, Muhammad Saifuddin Hashim Musaimi.

(2) Marsden will face 57 charges, while his wife Phan Sew Ken, a Malaysian faces 48 charges of money laundering totaling to RM45.9million (about USD12.4 million)

(3) The court has set January 4th 2007 for next mention of the case. The accused were represented by their respective lawyers.

p/s Utusan Malaysia reports BM as being 58yrs old and Sharon to be 51yrs old. Strange, Berita Harian says they are 57 and 50 respectively. :tongue:

I invested in Dec 04 and should be a millionaire by Dec 05 and now I am supposed to be a multi-millionaire without a care in the world in Dec 06. Instead I am trying to make ends meet. The irony of it, all we wanted was just to buy a house and now instead of being able to do it, we struggle.

This is what Off-Shore is talking about. People with burdens and debts, pensioners that want to live the remaining part of their years in comfort are forced back to work. A cruel prank of life?

Back to work for me, at least I still got years ahead of me.

Serving time in a Malaysian Penitentiary is for the cases brought about within Malaysia. It may appear... you are set to extend that prison term through another legal justice system, US Justice am I correct?.... I hope its not the equivalent of Guantanamo????:biggrin:

Why throw good money after bad , Let the Malaysian justice system deal with him . If he is proven innocent well and good ,If not it's back to the drawing board . As we say over here if you never never have a go you will never never know.

yes that's true swisscash is ok

advice from someone here. Not free to discuss my case in detail within
this forum, but my situation may be unique to many members regarding liability for claims. Like many I've read about, I've lost a lot and worse still, I've indirectly been the cause of huge amounts lost by friends who trusted
my poor judgement. Someone must pay...

I was just wondering if any of you had considered if BM does go ahead with his trial and not plea bargain, would this mean that he would have to reveal his super secret trading formula? It seems he would have to explain how he was generating all those fantastic profits, which means he would have to reveal his program. If so, who would need PIPS after the trial? Anyone could replicate this feat since they were given the blueprint to do so.

Now before anyone thinks that I believe he could do any of what he claimed, I don't, but was just wondering how he could prevent from revealing this in open court.

Lots of people (including me) have a red face and ongoing "situations" for introducing family and friends.

There is going to be publication bans on all the evidence. The court room will be closed to the public. Nobody will get the formula, nobody. Just think what could happen if it fell into the wrong hands, like a bank or something.:eek:

Well,if BM opts for a plea bargain you will be right.Nobody will get to know the truth.Given the circumstances, I reckon BM will opt out of a full trial.

Yes and that would be you and all of us who were so insanely greedy to believe that we could get rich so easily and quickly. We have nobody to blame but ourselves. I don't recall seeing anyone forced to join PIPS at gunpoint. It is time to get over it.

Looking at the chances or odds as viewed by most, going for a plea will irrefutably reflect that he ain't given up and is non repentant and destined to scourge more when he gets out and alleluyah to those handfuls that ain't learnt any lessons yet...

A full trial will simply blast away his underlying schemes that will also show just how devised it trails back to the early GW days and the BIG Heist was being worked on unfortunately, for the stubborn stance and failure in understanding key success that goes hand-in-hand with good & consistant communication and NOT being bashful either, that all blew his cover and plans...it was all a matter of time until BN stepped in!

Why bother to be positive on behalf of BM?....my take on it is that he has been digging a big black hole and he is no longer able to climb up again!

The most positive about this situation is that the trial is getting closer every day, but unfortunately the situation does not look good for BM!....and according to BM, the tunnel is no longer bright!...lol

Thank you, theBat$, it is good to get something that tells us that not all has come to a stop once again. Hope from Jan 4th on we get better action by the court. It seems all so slow. All tyhe more reason to thank those who keep us informed.

I am blaming no one but myself for my PIPS woes. I took funds out of an IRA for PIPS (thousands), paid huge taxes and fees in addition to the amount invested, and have nothing to show for it. What rings in my ears is the PIPS disclaimer regarding risk (paraphrased) - Don't invest what you can't afford to lose.

There ya go, baby. How could I put myself through any more grief or expense by chasing ethereal justice?

Maybe Bryan didn't hold a gun to our heads what he did was worse , he lied he made false and misleading promises, principal in Pips was "GUARANTEED" by an insurance policy even named the company extolling it's virtues.
He created a bank, PICPAY , which was, " NOT AN INVESTMENT VEHICLE" which every third poster here seems to forget......... and was suppose to back by GOLD and 100% SAFE.

The crimes he was charged have have nothing to do with Pips the investment but with Bryan's apparently fraudulent taking of Pic Pay account holders monies and transferring them to his own accounts.

He stole mostly from those who could least afford it...

Maybe we were all stupid for believeing these lies but, we do have Bryan to blame and we have the right to seek justice and hopefully we'll at least see that.

It is time to move on, time to heal oneself , and time to get over one's loses
