    Default PicPay v MyKad? Insight into Malaysian Law

    C Information Content and Applications

    While the MyKad was originally intended to contain four applications —the national identity card, driving licence, passport information and health information — it now incorporates eight applications, with the possibility of additional applications being integrated in the future. The other four applications are the electronic purse, ATM access, transit application (the ‘Touch ’n’ Go’ feature) and the Public Key Infrastructure (‘PKI’) feature for online transactions.[38] In the near future the government intends to merge the MyKad with the Payment Multi-Purpose Card (‘PMPC’),[39] which will enable the MyKad to have debit and credit card functions and other financial applications.

    The MyKad replaces the existing paper-based laminated national identity card as well as the driving licence. It displays on its surface most of the information currently printed on the existing national identity card, driving licence and passport.[40] However, pursuant to recent amendments to sch 1A to the Regulations,[41] additional personal information can be displayed on the card’s surface and stored in the chip. Consequently, the cardholder’s gender and religion (if the holder is Muslim) are now displayed on the MyKad surface. The chip contains information including: race and religion (for all), thumbprints,[42] polling station code and date of registration as a voter, code for criminal record and restricted residence, driving summons or compound[43] and demerit points and health information.

    Apart from personal identification and driving licence information, the MyKad also complements the Malaysian international passport for exit from and re-entry into Malaysia, although the passport is still required for entry into and exit from foreign countries. It was originally announced that Malaysians travelling to Brunei would be allowed to use the MyKad in lieu of a passport,[44] but according to the NRD Director-General, Wan Ibrahim Wan Ahmad, this development has been delayed due to a need to protect the personal information in the MyKad when the card is used as a travel document.[45] Health information in the MyKad includes blood group, any allergies, implants, long term illnesses, medical prescriptions and dosage, and records of the holder’s last two ward admissions or clinical visits and diagnoses (if any).[46] In addition, while he was Prime Minister, Dr Mahathir announced the inclusion of additional information on marital status[47] and voting constituency.[48] This announcement indicates that the nature and categories of personal information that can be stored in the MyKad in the future are not closed.

    The electronic purse application in the MyKad facilitates payment for small purchases and can be used for commercial transactions and transactions with government agencies (which until now have required the cumbersome process of obtaining bank drafts or money orders). The ATM access application allows storage of up to three bank accounts in the MyKad and enables MyKad users to carry out common banking activities, such as cash withdrawals, balance inquiries and transfers of funds.[49] As part of the transit application, the ‘Touch ’n’ Go’ feature facilitates payment of bus and light rail transportation fares and parking fees, as well as payments at toll booths and at other outlets which accept this payment system.[50] The PKI application in the MyKad provides security for online transactions as well as the transmission of information over networks because public-key cryptography allows for the use of digital signatures and therefore for the authentication of identity.[51]

    Proposed applications include Employee Provident Fund (superannuation) transactions,[52] voter registration, ticketless air travel and car park access.[53] The MyKad is also now used by organisations to control the access of visitors and employees to secured areas,[54] for work scheduling and for the internal flow of information and operations within these organisations.[55] As indicated by Dr Mahathir, the possibilities for usage of the MyKad are immense and ‘[t]he journey into the digital era has not just ended with th[e] launch [of the MyKad], rather; this is the beginning of a new era of civilization.’[56]

    At present, the MyKad is optional for Malaysians except where they have lost or damaged their existing paper-based identity cards[57] or are applying for an identity card for the first time.[58] Administratively, however, the NRD has ceased to issue the existing paper-based identity cards since 31 July 2001.[59] Thus, there is effectively no option — all Malaysians will at some stage have to change to the MyKad.[60]

    The MyKad therefore represents, on the one hand, a single smart card that can be used for multiple purposes and which the government promises will propel Malaysians towards ‘an incredible transformation in their lives’.[61] On the other hand, the MyKad contains, in one card, considerable personal and potentially sensitive information about the cardholder. It also has considerable capacity for expansion into other domains. As a result, serious information privacy issues must be urgently addressed.

    Talk about dodgy.. In Australia here they brought in a MIcro-Chipped Passport since October 2005.. I dont know what sort of Information contains within the chip.. I've notice every day, here in Australia.. new codes, laws, licences are coming out every day.. our rights are getting stripped away over time....
    What are Religious experience, governments are like Religions and their practices and doctorines is the law and penal system lol...

    No doubt that this program in Malaysia will turn out to be the pilot program for foisting this "Mark of the Beast" on the rest of the world. Maylasia is not a true democracy. The leaders can do whatever they want. It's citizens are quite vulnerable. So are it's guests, as we've so painfully learned.


    As citizens of the "free world" we must remain vigilant. Democracy (like business) requires us to stay informed. We must maintain a constant search for and support of leaders who won't sell out to the highest bidder - and immediately remove those that do. Also requires our own constant participation. VOTE! Freedom never comes free!

    I sincerely believe "things" are getting ready to get real rough all over the world and everything "WE" leave undone now will come back to haunt us sooner or later. More importantly, the grand children.

    Very well said!...unfortunately a huge part of the people on earth are not as fortunate as us! Secondly, too many that has been given the rights are still walking through their lives with blindfolds!

    Seems like the American Bush administration doesn't even need a stupid little card.

    Apparently the bipartisans have been so busy trying to "WIN" - nobody is actually watching or minding the store!

    Hi nanni

    Haven't really been gone - just have little to say these days - watching "humble request" mainly. And Working.

    Over the months past I have been looking for clues to what the conflict between certain Maylasian "officials" and BM might be - as mentioned by the "advisor" you quoted in one of your first posts here. I thought that the doc I posted above may be revelant. Maybe the Maylaysian government doesn't even approve of "free enterprise" as we understand it. Maybe it's just jealous.

    Hi John

    Have been without a computer for a few days.

    Yes, I feel it's time to look into it again. My "feeling" tells me they just need to realise they need to let go of the money. They can't hold them back forever. It's our money, not Bryans or BNM's.

    I wish we could start to sendt "releasing light" to the BNM and the Authorities. Make them realise that they just have to let go of it. They just can't hold the money, nor anything else back anymore.

    It feels to me (more or less) it's only a "decition" away. Someone needs to realise it's really against the law if the continue to hold it back. Thats why I wish we could joins hands again and send massive light to them telling them to let go give us our money back.

    BUT. This is also about us (as a group of people) believing we deserve to have money, deserve to get our money back.

    We need to welcome the "energy of money" into our lifes. Believing we are worthy both to pay our debts and have more money, so we can afford to both give and create more good things, jobs etc.

    There is more than enough money in the world for everyone. Money needs to circulate to grow.

    The Malysian Authorities and BNM has been a "tool" for those forces/energies/people who don't want free flow of money in the world.

    Most of us here in Rolclub believes in and wish free flow of money. The energy has been "stuck" for a while. It's time to let go. Wich means we also, as individuals and a group of people, needs to welcome the energy of money into our own lifes. Believing we deserve it.

    Wich means, on a deeper level, we also need to learn how to love ourselves. A lesson who can be hard to learn for everyone of us.

    We have to believe we deserve it, and we can send light, good thoughts and visualise the money comming to us. It will create a very strong energy and signal into the universe and right into the offices in Malaysia too.

    Hope you can help me start this John.

    you got it baby. I think it will be decades before Americans and the world know the depth of the damage done by this administration. The word IMPEACH comes to mind, but who would that leave us with? yikes.

    Hi nanni - BNM is not concerned with your "feelings" and certainly not inclined to respond to them! The "power of positive thinking" is for you and your life. It is not intended to give you power over other peoples lives. Unless, of course, they ask for it. Of course you MAY pray that Wisdom and Love enters the heart and mind of the decision makers as they decide our case.

    ourhouse37 - Bush is just trying to "win". Like Pavlovs dog. He is not the real problem. There is only ONE America. Ignorant (to ignore) and apathetic (to DO nothing) citizens have allowed themselves to be brainwashed into believing that there really are "blue" states and "red" states and one is "right" and one is "wrong". The BI-partisans are laughing all the way to the bank. As long as "we the people" continue to trust in the power of money and competition more than God and Love, it will only get worse - no matter who holds the oval office! As Peanuts said, "I have seen the enemy - and it is us"!
