I have listened to us all gripe and become aggravated with each other and at times with Bryan over the actions of the BN in freezing our accounts. In essence we have accomplished not a thing except vent our spleen. All we do is only react to the circumstances the bank has created.
My understanding is that as long as we only react we will never control the situation and that is absolutely evident in where we are now. I think it is time we started to think how we could be proactive in this situation and in that vein I have a thought.
We specifically and Bryan I assume( because no charges have been laid and he is a good guy anyway) have done nothing wrong. In spite of this BN has severely financially prejudiced the financial existence of us all for nearly twelve months. While what the bank is doing is clearly within legal guidelines. It would seem a case could exist under common law, that the time taken is too long..
Under common law we have obligations to other people which the law recognises. If Malaysia does not have a code of law similar to the British law system which includes common law, they would have a form of law probably based on the Shari a This is divided into religious duties, and, obligations to other people. Not too different to our common law.
A good Malaysian counsellor should be able to identify whether we have a case.
I think it is time to be proactive. We should discuss this with BM and get his feelings and support for us to, as a group, take a class action against the bank for at least, the protracted time they are taking to resolve the matter.
If such an action is considered legally viable and each and every one of us was to contribute voluntarily between say $5 and $50 we would have a money chest of some millions of dollars and able to finance expert counsel for the task.
I throw this in for discussion.
I agree , this is been going for ever with any updates from the bank or any officials handeling the case . We should be intitled to have some sort of news by now . In the end it is OUR MONEY NOT BANK MONEY.

We have gone down this road before on many threads. It will serve no purpose to file a class action against BN to release information on PIPS. If anything, it will only make us wait longer for the investigation to finish. I know it is getting harder to wait as each day goes by, but that is our only real option.
I am not suggesting we should compell BN to release any information on PIPs I feel they have a moral responsibility to all pipsters to resolve this matter in the quickest possible time, which they are not doing and will not do unless we compel them to. I include Bryan with us because they are also doing the wrong thing by him in particular.
If we have a case and can force the issue of resolution, I feel we should do just that, with the support of Bryan of course.
I'm sure this sounds like a reasonable idea...if PIPS was the only item on BN's work agenda and all their resources were thrown into sorting out the investigation into this one company...unfortunately common sense dictates that this is a very small part of their overall work and thus it will take as long as it takes with whatever resources are allocated to it.
Just because it is important to us doesn't mean it has the same inportance to someone else as i'm sure that other people/businesses/companies that they would also be investigating would think that theirs is the most important - that's human nature - IMHO being patient is all we can be.

I agree with your point 100%. Yet I am not sure how we can compell them to release any info based on moral responsibility. I have never heard of a major corporation or business making any decisions based on moral responsibility. If it does not effect the bottom line then it it not normaly done. I do feel they have our funds locked up and seem to be dragging their feet on getting this investigation done.
Good point Workeasy. That is one of the main reasons the investigation is taking so long. PIPS is a small blot on their radar. Remeber that if PIPS was found a scam their would be no need to strech this thing out this long. It is in our favor that they are still investigating PIPS. This says to me PIPS is coming back and their is no legal issues or charges being filed against PIPS.
not neccessarly bburgess........ if a company is found doing the wrong thing it takes a great deal of time to prepare all the information ready for court. If it`s clean it`s relatively quick to release the said company`s books and thats that.

I am not particularly talking about only a moral responsibility. My thought is that both Common Law and Shari a Law address this problem of delaying justice (outcome) as a legal responsibility.
Instead of the bank putting all the pressure on us, we can take an initiative, if agreed by wise counsel, to put the pressure on BN. The banks are subject to the law exactly as we are. It's just that at this stage, they have all the financial resources on their side. We can, if we chose, change that.
We can of course just sit and wait but if this is anything like what occurs with the Reserve Bank or SEC in America, we'll be waiting for three years and more with still no resolution. Chat to people who have had fund frozen in America.
I do think what is important is Bryans viewpoint on this also.
And also 300000 complainants is not a small issue for any bank. It is a major catasrophe.
Well, even though I am one of a chorus, my 2cents is that you NOT antagonize the bank OR the Malaysian government with further "communications". Please, please, please keep in mind that "additional communications" with the Bank is part of what has led to the ".....dragging out...." of this process. EVERY complaint must be examined, even if nothing is done about it. Whether or not your intentions are good and noble, this ISN'T the US system. We are not high on their priority list. Look to our own government and how they keep things locked up when they want to. Doesn't matter how much or how long you sue. All you will do is make an unpleasant situation that much worse. IMHO, this is not a wise course of action.

Well, I am currently in a lawsuit with the city in which i live and this has been going on since 6-05 we are just in the stage of depositions and all the legal stuff it takes a long time to get any response from anyone and that is really frustrating what I thought would be over in a month or so will be a year in June and I live in the US so this thing could be a longer wait then any of us could imagine. Of course if navinmudi post is creditable we wont have to worry. But one point I would like to make clear and that is if we ever did decide to take a class action, for me it would have to be with Bryans approval. I feel it is of utmost importance we work together on this.
I was very excited to read navinmudi's post. Then I had to come back to reality. As Bryan stated "if it aint from him..." I really hope it is true, but how many times have we been let down with false hopes? I will continue to believe, but this time I will need official news before I jump to any conculsions.

There are several but two key camps of pursuing parties on either extreme is evident here... I myself am in one of them... not necessarilly with either extremity we get to witness on our Forum however, it has to be understood, EVERYONE is rather "depleted" with funds when the thought of scraping the insides of their cookie jar comes on offer.
But to stay focus on your "lost" funds...that, we must not give up....with a good measure of positive hope tied to it.
I can relate to those desperately at a loss with what is going on, cheering support of any other programs while the fray and futile search for a credible answer still seems like only an echo in a far distance reaching deaf ears...

Fair enough, Jumpin' Jack, but the fact remains that we can either wallow in self pity and frustration, or we can look to the bright side of life. Not a day goes by when I don't think about how I could have done it different, better, or worse. The point is to learn from my past, but live for today.
The fact remains that today, right now, we know no more, no less. We don't know what tomorrow will bring. Unlike so many others, I CHOOSE to look for the sunshine, I CHOOSE to hope that it all works out the way it should. But I am not going to give in to the temptation to beat down a man I do not know, for crimes not committed, all because I don't like the way it went.
Tell me the sun will rise tomorrow, and I am inclined to agree. But there are no guarantees that I will even wake up. Is this fatalistic? No. It is realistic. Tomorrow isn't guranteed for any of us. Neither is anything else. Disheartening? Perhaps, but I refuse to see the glass as half empty. If it doesn't come back - oh well. If it does, that's good too. It is senseless to continue to beat this to death.

It's Mr. Marsden who should be apologizing to the members of Pips not the other way around. Mr. Marsden was still taking money from me when he knew he wasn't going to pay me out, where is it all?
I have been in touch with the High Commission of Malaysia here in Ottawa, Ontario, Canada to see if they can intervene and find out at what stage the bank is at in their investigation as under Canadian Law I have the right to know. Even they are having trouble getting any information from the bank so can you imagine anyone of the Pips members trying to obtain infrmation. Maybe some other members around the world should do the same. I really don't care at this stage if it "rocks the boat" or not. For Mr. Marsden to simply stay away from the forum it sheer "arrogance" on his part.
Perhaps, but that is not the crux of my message. What I think about Mr. Marsden or the current situation has absolutely no bearing on what is, and what will be. I am merely stating that ALL attempts to "force" or "discover" what is going on has only served to further antagonize, frustrate and anger members. It serves no purpose. When something is to be known, we will know it. There is NO WAY that Marsden, BNM or anyone can keep this a secret.
Do not be so quick to judge when you don't know the situation. Can you say that he is being arrogant, aloof, unfaithful, etc........... based on what you KNOW or what you THINK, based on what you have read? I reserve judgement for the proper time. Until then, whether I like it or not, whether I agree with his methods or not, it is what it is. I do know enough to understand that there is much, much more here than meets the eye. If an apology is in order, I too, would welcome one. I definitely would like an explanation (eventually). But today is not that day.

I agree with the recent post. Sometimes things so obvious ,but if you look at the "pips" situation and the "radar"which pips was under it makes sense that the situation may be dealt with is a bit different format.I believe if you think "outside the Box" it makes sense to pursue in that direction in not letting anything known.The elite think it that format , it meets or exceeds what the eye can see.my 2 cents.
