PIPS and Animated Bible Episode 2

Hello PIPS Members,
Below are email messages sent back and forth between myself and Tom Broadbridge concerning when DVD number 2 or episode 2 would be sent out to PIPS members who had paid for the whole series through the special offer. Since the first episode was sent out and I did receive it, I believe Tom and his company were paid appropriately for all and should send all episodes as they continue to be produced, regardless of the current situation with PIPS. I did not see any indication of any conditions on the website or receipt, relating to the release of episodes being dependent on any other event happening. The bottom line here is that “THEY WOULD NOT HAVE SENT OUT ANY DVD’s (even if it was only a partial shipment) IF THEY DID NOT RECEIVE PAYMENT. They accepted the payment (even if it was picpay) as consideration and are liable to fulfill their end of the contract (that being to ship the DVDs). What are your thoughts about this? :flame:

The thing is that you accepted the payment and considered it of value enough to send the first episode, so in my mind you have been paid forthright from me. In other words, you would not have sent the first episode, if you were not paid in full. Your website and receipt said nothing about any conditions concerning the releases of the episodes being dependent on any other event. I entered a contract with only you and fulfilled my end of the agreement with consideration that you considered good enough for the 12 episodes. I believe you were paid appropriately and are using the current situation of PIPS in order to dupe paying customers out of their money. I am not going to pay you twice for the same thing. Wait till picpay matter is resolved.
This is almost the same senario that caused the current status of plexpay.

I think anyone would not want to sell products at a loss.

That is like saying that you ordered something from a Paypal merchant but Paypal never transferred funds into the merchants bank account but you still expect your product to be delivered? I'm also with Tom on this. He received nothing from you, only some Picpay which is worthless unless he can change it into actual currency.

It's like you paying by cheque and then the bank cancelling your cheque because you had no money in your account and then you demand the goods saying that you sent him money.

Sorry but I have to agree with Tom, If you had paid by cheque which your bank then refused to honour would you still expect goods to be delivered - I think not!!

Someone mentioned that I must be a troll. That is baloney. I'm not the villain here. I just want what in my opinion was rightfully paid for. The thing is that if Tom had not been paid, then he would not have sent the first DVD. I know he did not send that DVD for free. Now, did he? Some of you have me convicted and crucified because I simply asked him a simple question in which he chose to start the name calling and such. He is the one who should have kept his head. Some of you did not even order the DVD's. If you did, then I would bet you would have the same thoughts I do. Many of you post on nothing more than speculation. This is not speculation, it is pure fact.

Oh, I forgot to mention that many of you act as if picpay money is play dough or monopoly money. If you thought it was any of the aforementioned, then would you have played the game (PIPS)?

most of us don't think the picpay money was playing money but PIPs has a problem and we have to wait till this problem is taken care of and then we'll get all our little problems FIXED with PIPS you/I have to wait till PIPS is back bottom line.
Oh, btw I had ordered the whole set also.

The first DVD was produced and printed...he had gotten a small amount of the money for the production, but the rest of the money was stopped when PIPS stopped............It made sense to ship the first DVD, but the rest could not be produced due to lack of funds.......This is what I have understood of the situation...............

Hi I also ordered the set of DVD's I understand the situation that everyone is in, if you have a pending withdrawal you actually do not have the funds in hand ,until then you have not been paid. Tom would be in the same situation, I am sure that he has received alot of complaints from disgruntal customers and after a few thousands complaints or questions with How come I haven't received my order. His patience has wore thin, walk a mile in his shoes and maybe we can be alittle more gracious and long suffering. Blessed are the peace makers, things will turn around soon. Keep your chin up!

From a legal point of view, the buyer(s), csluvbbq and others, should not have to suffer due to what said to be, "lack of funds". They, PicPay and the relationship with Tom's company, had to know of the situation and should under no circumstance allow payment through PicPay if there wasnt sufficent funds to cover the cost of the DVD offer. The payment made by the buyer should, when paid in full, be transfered to whatever account immidatetly. So, in my opinion you are in your full right to, and should receive your next 11 DVDs without having to pay for them twice. As you said yourself, you paid in full and "kept your end of the deal".

Why should "we" as customers suffer due to bad management and sales? I though Tom and Bryan was working close toghether, with the current situation in mind, not to mention the close relationship between PIPS and the Kids Bible etc. Tom should send the DVDs to hwo-ever accepted the DVD offer, after all, we (PIPS members) were responsible for the entire project, with our own money. Hey, where did you say our money went?

One more thing. Why do you people always badmouth and begin name calling anyone questioning PIPS and its businesses? I think everyone should take a moment and think who the real "trolls" are. Move on guys, please acknowledge that the PIPS saga is probably over, at least the way we know it. By know, if it had not been for the situation, we all be billionairs. Could you imagine?

...dont get me wrong. I still have some hope that PIPS will return. But I wont mourn over the loss anymore. And we do have rights you know!

Obviously Tom should only send out those episodes to people who have paid. If anyone is holding him to the fact of saying that he accepted the promise to be paid (ie PICPAY) so he has to send it to them even though he has not really recieved the payment --- then they are obviously trying to take advantage of the situation, obviously Tom will not fall for this as he stated.

so a couple of you believe Tom should provide you with goods that he has not received any remuneration for? sounds like an excellent way to run a business.

I guess I just find it more than ironic that someone who is selling bible dvd's responded with such hatefulness. I think Tom needs to go back and re-read his bible before he tries to make any more money off of it.

Pretty selfish to be moaning about some dvd's not received at this time. Not exactly in the christian spirit of the bible is it now. Therein lies the paradox.

I would have done exactly the same as Tom. Let the man run his business.

If tom have to paid, then ALL the merchant who own me gold bar ,cash card, voucher and so on ....... must paid me the goods.That will include all the rest of the pips member also.

Mabe tom should clearly states at his website about pips and his company currently situlation to prevent futher problem to arise.

I think Tom showed tremendous restraint in his response. I would have been using some R rated language if someone emailed me trying to tell me I owed him a product that was never paid for.

Not to mention i'm sure this isnt the first childish beggar trying to take advantage of the situation.

I feel I must add a comment here as I know how badly Tom must feel right now... and all the stress and pressure he is under in this situation which is most unfortunate for all of us. My husband and I were merchants ... Tom is a merchant selling a product with Picpay. We had 10 orders for computers that were PAID with picpay. Are you saying to us we should honor these and send these computer systems to these people who paid with Picpay????? How stupid we would be as business people if we did that.

What did you pay it with? An ecurrency that is no longer viable if it ever was... what legitimate currency are you out of pocket? $$ , Euros? GBP? How can Tom send you something for which he never received any true money... he is in the same situation as we other merchants... if he had a crystal ball maybe he would have foreseen what was going to happen but none of us did and he had faith that PIPS would pay as we all did. We hope that it still will... and if and when it does, Tom will send everyone who ordered that set their DVD's... I surely cannot believe you are that blind that you cannot see that you paid nothing .. and want something ... that would cost Tom a quite large loss .. which he does not have at this time.

I know that perhaps Tom could have answered without anger... but you request is totally unreasonable and he probably received other ridiculous and numerous complaints also.... you paid nothing and you want something for it.. put yourself in Tom's shoes. He has a lot on his mind right now.. including the re-design of the website and affiliate program and just trying to cover his costs and losses trying to get this all done for the Christmas buyers and it has not gone as smooth as he hoped on that end either (I know because we are helping with the redesign of the website and we would like it to go faster also) Life is never as we would like it to be sometimes but how we react is what helps us to grow. If he were angry, and did not show a "christian" response then God understands I am sure because since you have the first episode you know what condition all mankind is in... we all have failed and are in need of his mercy.

Actually, it all depends on the T&C's that are applicable to the sale.
Most merchants had specified that they would send their products as soon as they received the withdrawel.

If however the merchant's terms specified that they would send as soon as pipcpay was received, I would think that those merchants have a problem on their hand.
They were legally bound to send out the products when the buyer fulfilled its part of the bargain (the correct transfer of the required amount of picpay).
Does it make sense to demand shipment of the product?

I think not. Look at the situation with the bible. I don't know what was specified in the terms, but in all fairness, we can all understand that the company would be out of business immediately if everybody would demand shipment of the items. So who would win here?
Nobody! Chances are that you wouldn't get your next episode because the company was unable to produce it and subsequently send the item to you.

Depending on the T&Cs you may have a legal right, but that still doesn't mean that it will be acknowledged.
