Need a Legal Aid

I would appreciate your comments and legal help regarding this e-mail I received today from so-called friend:

Hi xxxxxxx,

Just thought you would like to know this advice that we have been given recently.

After much correspondence with various bodies it now turns out that even if Bank Negara manages to recoup part of peoples monies we will not be entitle to any.

This is due to 2 reasons:
1/ Had we dealt direct with PIPS they would never had processed the transaction. As NO new transactions were accepted from early January. (Meaning we would not have lost a penny).
2/ As all our payments were made to you we have no contract with PIPS binding or otherwise.

Also PIPS was actually illegal in this country as it wasn't licensed with the appropriate authorities so should have not have been traded in this country by anyone.

With all these things being taken into consideration we have been ADVISED to issue a 30 days notice to you for the return of funds, or take court action if not resolved by then. Also to pass all payment information to the FSA and the Inland Revenue as these organisations are now investigating peoples association with PIPS and people profiting from selling units of this scam.

This only came about due to the fact that we had to remortgage to clear the credit cards and loan that we took out for PIPS. Which has also meant that I have now had to go back to full time working rather than part-time to cover the new mortgage payments.

Both our solicitor and accountant have advised similar action due to us not having received anything for our money and not being able to recoup this money any other way and also being liable for it on our accounts as we have no proof of what £3500+ was used for.

It's A Load Of Tripe . Bin The Crap .

I would simply say that if you are forced to return those funds,
make sure that you ask for official documentation that all accounts be
turned over to you.

There's no problem in returning the money but what bother's me is that that person ask me to make a transfer on several occasions and even thou I pointed out the pros and cons of that program he/she still went ahead.....and it wasn't even me who introduce him/her with PIPS.

You need new friends. I'm glad repaying won't be a hardship for you and I hope your "friend" doesn't accuse you of selling PIPS units, or cause you any further grief!

There will be a letter (Email) sent to all of the buyers from our Lawyers stating our position on this matter, and the legal ownership of the goods that you have purchased.

I'm not sure, but can the merchant do this, since first of all we agree that he sell product and accepting picpay, and I did pay with picpay. so if picpay for some reason close down that's not in our agreement to repay this with other method right?

also if you guys remember, all product that being sold at picpay was double or atleast much higher than their retail price, so if the merchant ask to repay does this mean I have to pay thats much...

Indeed, if funds are required to be returned, seller should at least forego the mark-up. RSK

It may differ from country to country, but here in Holland, if the conditions of sale do not specifically include that ownership of the goods is transferred after payment is received, the seller has no rights.

Second, you agreed to buy a product paying in picpay dollars. They offered to be paid in picpay dollars and you accepted their offer.
In my opinion they legally cannot force you to be paid in real dollars.
Now, you might want to get into contact with them and see if you can meet in the middle. Saves you the hassle from lawyers and collection agencies, but before you do that, they need to return the picpay dollars (and how are they going to do that, I ask)

I understand your predicament. I suggest that should they start getting "tough" etc. Your defence is that you pointed out the pro's cons, risk etc etc. And still at THEIR insistence not yours that it was their decision to go ahead. You did not make them do it.

I once had the Situation that someone bought product from me, and on a whim no longer required it. They went to the Office of Fair Trading, who phoned me. The first thing I said was I don't want to know about it on the phone, send me a letter. That way I could have all the issues in writing and I could answer them accordingly point for point, rather than taking the standpoint of trying to justify myself without thought.

Duly a letter came, and I answered every point, and concluded that if they wanted more information to contact me again. The whole thing went away.

You see the first communication is intended to make you run scared and give in - its bully tactics, its its got u running.

I suggest you face it straight on in the same way.

Am I reading this correctly? The writer of the email had to return to full-time work because he remortgaged his house to pay a credit card/loan debt of approx. 3 500 pounds?

Everybody had to sign an agreement between PIPS Inc. and themselves. In that agreement it is stated that the one loaning money takes the risks themselves.

Also, how many times hasn't Bryan and many more warned everybody NOT to invest what you can't loose!

The risk lies entirely in the loaners own hands!

But this is not correct, is it? You could send wires directly to Picpay all the time if I remember correctly...

Oh dear! Messy business. I did order a Sony Digital Camera T33 with PICPAY dollars in March/ April. Of course, to date, I am still waiting for it. Does that mean, by law, I get the camera? Will we get our funds back? I did invest around $1000 with my credit card hoping for a decent return! How wrong was I?

Personally, I don't think PIPS has gone bankrupt! Where is the money and assets gone?

Well guys, I dont know, maybe we have to forget PIPS and just move on. For me, I am trying to move on and forget about it, all my mates say move on and get real! One day, I really want to prove them all wrong. Never mind, luckily, I have already joined one program that will be launched on the 31st October 2005.

I wouldn't give up on PIPS yet. The BNM hasn't completed their investigation and until that is accomplished we really don't know anything about what might happen. I can assure you that I have much much more invested in PIPS and after having done my DD and then meeting and talking with Bryan and many of the older members that have been with him since 2003 I feel sure that his word in one of the messages that the members will get their money will be upheld. I am not saying not to do other things in the investment lines as it is always good to not have all of your eggs in one basket, but don't give up on PIPS either.

PICPAY will not be back, that gateway to process our w/d's has had too many
problem to continue, you will see a new revemp gateway after the investigation
is complete, all pending w/d's will be the first order of business.

PIPS will continue, very likely there will be some changes, one thing which will be
always be part of any program involving Bryan, will be the charity aspect, Bryan is
a man who is dedicated to help the needy ones, and humanitarian help is a goal.

What you will see at TG is going to be a marathon similar to a bunch of devils trying
to swim in holy water.
