Hmmmm, indeed. I'd be interested to know a little more about who this guy is as well.

It seems to me that it would be in the best interest of all PIPS members to be formally represented at the trial in September so that the Court can be apprised of the views of the membership. I realise that this would be expensive and, of course, I'm not certain that the Court would permit it. (If they follow the British system, on which the Malaysian system was originally based, then a lawyer would likely have to apply for permission to represent interested parties).
Should we be looking at trying to raise funds to cover this? With many PIPS members having invested six figures and more in PIPS (not me, I hasten to add), surely there must be a few PIPS members around who could help fund it?
Brian
The court case is not concerned with Pips. It is only concerned at present with transfers made by the Marsdens into their personal accounts, transfers which are ajudged by the authorities to be fraudulent in nature.
Whether the court would be interested in the views of those who gave their money to Pips is a moot point. Frankly, I don't believe so. The Central Bank have no obligation to protect investors from fraud - caveat emptor applies here - and they have effectively closed Pips down which was the object of the exercise.
They may, of course, elect to press further charges which may well implicate the company. In this case, I would expect them to obtain evidence from those who invested funds.
I'm back, preparing/drafting update I received from our Man in Malaysia, thebat$, our Moderator and RC Anchor on site...
YB.
What I heard from thebat$, was an unusual disembarking of his overnight semi-comfy luxury coach operated by Consortium, halfway through the journey some hours past midnite. This is scary, VERY... if that coach trip was in Iraq!!!
A switch of coaches took place and he being "groggy" with luggage unloading on the highway and all... safely made into the terminal at Seremban in the early hours on Thursday 12th, April.
Baffled though not bruised, he had to make his way close by and on foot, lugging his carrier bag to hotel only to find and be told, he is not booked-in after all...no proof on his reservations were done/recorded by phone!
He then tried from there to make other reservations and had many disappointments heard again untill finally, got through to one in Kuala Lumpur, but that journey will needed be needed after the hearing later in the morning once the trial has ended for today.
He had to go get some decent breakfast and stayed within close proximity of the Session Courts that is best reached with a cab. Cabs are, to his amazement, much more expensive as opposed to his hometown in Penang!
With the help and friendly assistance of a DPP, she managed easy access to relevant information to give Batty a headstart and towards the precise court building/room. He seated himself as close as he can but remaining discrete from the defence bench.
The Press were present!!! But they remained to stay outside for the sole reason and that on the cases before the Marsdens, when the Marsdens case was brought up, were of little importance he later learnt. The emphasis was far from expected for the case our Anchor man was there to cover!
There is another much more prominent case to be handled and the key defence person is a local tycoon charged with some other domestic case involved with a Supermarket chain.
Thebat$ was however confronted by some other Press guys when making his exit from the courtroom. They just wanted to know if he was there and covering the local tycoon's case instead but when it was mentioned about the Marsdens and the Fraud involvement, it was brushed aside as a small if not, insignificant trial. Hence, no real focus is shadowing the Marsdens at the moment, esp. when today was merely to pick up where it was last left off in January.
Batty stood around to familiarise more with the courthouse and surroundings and managed to snap a pic of the premises, from the outside view. None taken on the Marsdens or Defence lawyer and within the time of the hearing that the motion was carried forward to May, and again, only by then to re-appear and discuss/confirm the trial date in September, despite dates were opted by both Defence & Prosecution lawyers. In May, the September date will be confirmed eventually.
In the meantime, Batty made his way to KL, the capital of Malaysia to go check in with the hotel. Once there, again, they informed him, it is FULLY booked and no records...bla,blah, blah!!!
However he left with the assurance that an exception will be undertaken to get him a room eventually and hopefully, he'll know of it by a return call within 3 hours, giving him time to move about town and perhaps go get some grub... he didn't have the stomach to crave for Satay though... it was pouring like cats & dogs at that moment!
When we were having our hour long telco, he was at an Eating Complex and I was in another town by my side. He was quite upset about the hotel outcome, I reminded him to demand for the Reservation Booking Reference when the hotel next call him. I also wanted to know if the current funds are adequate to cover his stay and travelling untill he returns to his hometown and he believes he can manage it thriftily. Reminded him to avoid using his CC unless absolutely necessary, he understood that.
We won't publish those relevant contact nrs or details that leads to the various depts which Batty now has secured, fortunately. I hope MOST of you will understand the reason behind this, as there are among you, some elements who will do anything to gain such information for their own use, lurking within our forum, and is not actually serving or supporting our initiatives at all... thus, don't ask for it, it is in good, safe hands and we will treat it as such!
He then plans to make his way by a short train or taxi trip to the various Pi Inc establishments and research for more information. Snap whatever pics possible as well.
He'll make his way, after checking out of hotel and cover as much grounds before nightfall and safely make home by overnight coach again the next day, Saturday i.e.
I'll be speaking again with him as I promised to call him. As for the trip to the May hearing, we did come to the conclusion that a trip may be necessary, though a short stay is all it needs so he gets 1st hand and upfront coverage... I think, you all will agree to this too...but we shall see when that week approaches.
It was great chatting with him and trailing onto other non Pips issues too.
Thank you all for reading this post.

Edit: after some proof reading made, given the relax time I have now. - YB.
Do you think it would be too much to ask, if we organize another trip to have batty or someone else go visit Brian in Jail? I don't know about the rest of you, but I would like to know what Brian's state of mind is like... and hey, why not give him atleast a care package. Nobody is exempt from being in either a hospital or in a jail in this life. What do you guys think?
I think alejounoa has a good idea and hopefully enough funds can be raised to accomplish this.
Well done Yogi.. i see you have your reporters hat on now !
Your info is well written around thebat$'s update, to give us more inside details on what he went through to get us the facts. Frankly this is the best update in sense of information getting to us, since the time pipsinc went down ( compared with all the other updates from the newspapers...)
Proud of you guys doing a great job in getting us updated, from around the globe.
Cheers

Yea, really Yogi, what Ray said. It was such an narration of the story that it was like reading a setup for a good drama novel ... I could almost feel the rain and the anx of the situation. And so the saga continues...
