alathad : Committee held oil and energy in the Council of Ministers of a series of meetings on Thursday, Friday and Saturday, 24, 25 and August 26 under the chairmanship of Dr Barham Ahmad Salih Deputy Prime Minister and the presence of the Ministers of Oil, Electricity, Finance, Planning and Trade, Justice, the representative of the territory of Kurdistan, a number of advisers. These meetings for the study of the concepts and proposals on the Law of hydrocarbon wealth and hopefully soon be completed for submission to the parliament for ratification by the Iraqi Constitution.
It is clear that this law to be enacted would have significant economic benefits for the oil sector in particular and the Iraqi economy in general.
The new law will open up broad prospects for investment considered as controls in the national interest in the sectors of oil and gas, which will have positive repercussions on the Iraqi economy. This was attended by some of these meetings, Mr. Prime Minister, Dr Nuri Maliki was directed to the completion of the draft law to ensure the Iraqi interest in promoting imports from its hydrocarbon wealth and harnessed for development projects in Iraq.

Unlike poor nations that created investment laws granting foreign investors privileges and economic concessions, Iraq is rich with resources and the shortage of investments is not at all for economic reasons, said an article in Iraqi daily al-Sabah.
Customs and tax exemptions and other facilitations granted by the investment law were not required as conditions for investments while the deteriorating security condition remains the main reason behind investors’ reluctance to invest in Iraq.
The Iraqi investment law provided great economic and investment concessions that could be considered weaknesses. They open the door to illegal profiting through exploitation of the gaps in this law and using real or fake projects to benefit from the law’s privileges.
An investor who will show interest in Iraq will not be weighing the economic attractions against the security condition and be willing to risk their lives and capital. Investors will rather be interested in benefiting from the law without facing the security condition.
The first item of article 10 in chapter three of the new investment law grants investors the right to transfer project capital and returns outside of Iraq in a transferable currency. This gives way to practice international money laundry in Iraq and opens the local market to trade of drugs and other illegal practices under the label of investment.
Item four of article 13 in chapter four allows investors to determine materials to be imported for the intended project. This provides a chance to make use of customs and fee exemptions to import goods for sale in the local market or for re-exporting. Or investors can import goods in excess of the project’s need and sell the surplus for great profits.
Investors are allowed to re-export project assets according to item three of article 24 in chapter seven. This could be used for illegal trading under labels of existing projects.
These gaps may be reason the law is exploited in a way harmful to our national economy, said al-Sabah’s article. These weaknesses must be revisited as well as the entirety of the law that does not suit Iraq’s economic capabilities.
