I also believe there is more at work within the banking industry than we know. There is no doubt that the Patriot Act and American banks were putting pressure on the international banking community to shut down operations they didn't like (whether illegal or not).

Could be Malaysia is looking for the type of banking anonymity that Panama has enjoyed for over 100 years. When investigating P**S myself, that was one of the reasons I was told the majority of operations were there.

Is there a possibility that Malaysia needed to investigate P**S for a couple of reasons. 1. Picpay was taking deposits and I get the impression that was illegal because it wasn't set up properly. If your goal is to be an International Banking Power like Panama, you want to make sure that your rules and laws are followed to the tee.

2. The US Feds knew this operation (P**S) was up and running, wanted Malaysia to completely shut it down and the Malaysian Gov't wasn't totally ready to do that. So, they investigated the "illegal" deposits to Picpay because of no banking license or whatever, and this is the fruit of the labor.

Judging by the charges, etc. I think Bryan may be relieved this is happening. It hopefully finishes the banks work, allows him to get the proper structure in place and start again.

Is it a stretch? Well, I'm a positive person by nature and as others have mentioned, charges don't mean guilt.

Maybe if Bryan is proven guilty at least he will get a haircut which he wont have to pay for, he might even get free dental care which he desperately needs. Sorry just felt like lightening things up a bit. Whatever happens i do feel a bit sorry for the poor bugger maybe he really was trying to do good things and was just a poor businessmen. To go through life constantly looking over your shoulder, whatever be the outcome would be very hard to deal. I try to hold no animosity even though I lost a fortune. However my huge loss will probably be recouped in some way by not trusting as much anymore.

I don't know how it is in Malaysia but here in the US it's still innocent until proven guilty. I was always afraid it was a scam but hope upon hope that things will come to light that they are innocent and the restructuring will take place for us all.

I so agree with you. I'm not suggesting they are innocent or guilty, but I'm shocked that people are so surprised charges were pressed. Surely no one thought the bank would do this for a year and not press charges. I think it's a good day. If they are guilty, so be it. If he is not, then he's had a year to prepare for a defense. He had nothing he could do before as he hadn't been charged. Now we can move on one way or the other. The charges always sound so much bigger than they are. I worked in the legal arena for a long time and it's amazing how big they can make them sound and how criminal they can make someone look, then again some people are really criminals. Now it's up to them to prove their point. Supposedly they had this big plan on how to restructure and all that noise.. let's bring it on! He's a big boy, he should know what is legal or illegal and he should know he is in a country that may not take kindly to such activity. I will let them be the judge and jury. Just glad something moved.

I do hope people don't start to think that Gary Nichols or his side kick Bill and those guys are your friends or fall for anything they may come up with now. I know for a fact they are trying to get to the funds before we do. I think that's where the trouble started, but who knows. They sure sang pretty for the company before and they are sure bad mouthing it all now. Guess he just had no clue all the while they worked there and took our money? My guess is that if Marsden is guilty, Gary Nichols is just as guilty. I certainly hope they are banned from this forum.

SEREMBAN: Angry words and tears flowed freely when a local woman and her British husband were produced at the Sessions Courts in Seremban and Kuala Lumpur yesterday to answer charges of money laundering.


Phan Sew Ken, 55, and Bryan John Marsden, 58, were charged with 48 counts of money laundering involving RM34.2 million.

At the Seremban Sessions Court, the couple was separately charged with 41 counts, while later at the Kuala Lumpur Sessions Court, Marsden was charged with another seven counts.

Phan was on the verge of breaking down when she, handcuffed to her husband, waited at the foyer of the court complex before proceedings.

Some 30 minutes later, Phan was produced before Sessions judge Mohd Zaki Abd Wahab and claimed trial to all 41 charges.



Phan was charged in her capacity as managing director of New Mark Business Centres Sdn Bhd.

She was accused of receiving between US$39,253.48 (RM143,667.74) and US$499,963 in 41 transactions through the company?s account at EON Bank?s Nilai branch.

The offences were allegedly committed between Aug 12, 2003 and Jan 4, 2005.

The offence, under Section 4(1) of the Anti-Money Laundering Act 2001 is punishable with a fine up to RM5 million, or jail up to five years, or both.

The drama began when the issue of bail was raised by deputy public prosecutor Dzulkifli Ahmad.

Dzulkifli proposed bail of RM1 million in view of the seriousness of the offence and the amount involved.

Phan immediately asked Zaki for permission to speak and lamented that all of their personal and company assets had been frozen by Bank Negara for almost 12 months pending investigations into the case.

She said both of them have been on police bail since then, and during that period, had always co-operated with the authorities.

As she spoke, Phan, from Bandar Sunway in Petaling Jaya, began to sob uncontrollably.

"Your Honour, we are just trying to build our business and I was just giving moral support to my husband.

"Our lives are now destroyed and we have nowhere to go for help."

Zaki stopped her and said that the bail proposed had nothing to do with her business but to ensure her continued attendance in court.

Marsden?s turn was next and he too claimed trial to the charges.

Zaki fixed bail of RM500,000 in two sureties each for both husband and wife and also ordered for their travel documents to be surrendered to the court.

Zaki fixed Sept 13 for mention of the case to allow more time for the couple, who was unrepresented, to engage counsel.

The couple could not raise bail and before they were taken away, they hugged each other in the lock-up.

THIS IS TRUELY SAD. I dont know why, but i dont like to see people's sufferings. Maybe that is because i am a humanist. I wish them best of luck in court, and hope they win the case. This is truely a sad day for us all, regarless of us beeing pro-neutral or againt BM.

I am probably also feeling something similar to an Stockholm syndrome minus the hostage part. (if you dont know what that is = Stockholm syndrome - Wikipedia, the free encyclopedia).

I've just read through all 16 pages. You know, I've been away for a long long time and if anything the quality of the membership here has deteriorated.

The orgasmic euphoria being demonstrated by so many sad and bitter people over this news is just disgusting. I don't understand how someone can be so filled with hate to get so much pleasure over someones misfortune regardless of whether they brought it on themselves or not. How sad for you.

Has anyone here ever heard of the IRS? It is Not a U.S. Gov org - it is wholly owned by the World Bankers, and they are pushing for All "Offshore" funds to be monitored, since the Queen of England's personal bank is suffering loss as those funds are not laundered through her bank! The IRS is international in scope, and tied right in to the IMF. So, if you want to help the little guy, beware of the BIG GUY!

i kissed my grand goodbye when they first started the takeover. Not one of these programs will ever end in the glory they intend until we change the banking system. It's the risk we take to play the game. take it or leave it.

There is already talk of changing courts and a hearing on October 30th.

This will probably drag on like the investigation.
